 A BILL TO BE ENTITLED
 AN ACT
 relating to prohibiting governmental contracts with a company
 engaged in planning, constructing, or maintaining the border wall
 between the United States and Mexico.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Section 2252.151, Government Code, as effective
 September 1, 2017, is amended by amending Subdivision (1) and
 adding Subdivision (1-a) to read as follows:
 (1)  "Border wall" means a wall, fence, or other
 barrier on the border between the United States and Mexico.
 (1-a)  "Company" has the meaning assigned by Section
 2270.0001 [806.001].
 SECTION 2.  Subchapter F, Chapter 2252, Government Code, as
 added by S.B. No. 252, Acts of the 85th Legislature, Regular
 Session, 2017, as effective September 1, 2017, is amended by adding
 Section 2252.1525 to read as follows:
 Sec. 2252.1525.  CONTRACTS WITH COMPANIES ENGAGED IN CERTAIN
 ACTIVITIES RELATED TO BORDER WALL PROHIBITED. A governmental
 entity may not enter into a governmental contract with a company
 that is identified as engaged in the planning, construction, or
 maintenance of the border wall on the list prepared and maintained
 under Section 2252.153.
 SECTION 3.  Section 2252.153, Government Code, as effective
 September 1, 2017, is amended to read as follows:
 Sec. 2252.153.  LISTED COMPANIES. The comptroller shall
 prepare and maintain, and make available to each governmental
 entity, a list of companies known to:
 (1)  have contracts with or provide supplies or
 services to a foreign terrorist organization; or
 (2)  be engaged in the planning, construction, or
 maintenance of the border wall, including by providing:
 (A)  supplies, equipment, or other personal
 property; or
 (B)  personnel.
 SECTION 4.  The changes in law made by this Act apply only to
 a contract or purchase for which a governmental entity first
 advertises or otherwise solicits bids, proposals, offers, or
 qualifications on or after the effective date of this Act.
 SECTION 5.  This Act takes effect December 1, 2017.
