410 AN ACT
511 relating to the name of the Southwest Collegiate Institute for the
612 Deaf.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Chapter 131, Education Code, is amended to read
915 as follows:
1016 CHAPTER 131. SOUTHWEST COLLEGE [COLLEGIATE INSTITUTE] FOR THE DEAF
1117 Sec. 131.001. SOUTHWEST COLLEGE [COLLEGIATE INSTITUTE] FOR
1218 THE DEAF. The Southwest College [Collegiate Institute] for the
1319 Deaf is a postsecondary educational institution providing
1420 instruction for hearing-impaired students preparing for a career or
1521 for enrollment in a senior college or university.
1622 Sec. 131.002. ADMINISTRATION. (a) The college [institute]
1723 is under the direct control and management of the board of trustees
1824 of the Howard Junior College District.
1925 (b) The college [institute] and its programs shall be
2026 administered by personnel who are trained and qualified to work
2127 with hearing-impaired students and are fluent in manual
2228 communication skills.
2329 Sec. 131.003. LOCATION. The college [institute] is located
2430 on land deeded to the governing board by the federal Department of
2531 Education for the purpose of operating the college [institute].
2632 The governing board may not conduct regular junior college programs
2733 for students with unimpaired hearing on the college [institute]
2834 campus except as an integral part of the program offered to
2935 hearing-impaired students when:
3036 (1) it is educationally appropriate to enroll hearing
3137 students in classes for the hearing-impaired; or
3238 (2) special programs are needed to train hearing and
3339 hearing-impaired persons to become professional service providers
3440 for the deaf.
3541 Sec. 131.004. COURSES, PROGRAMS, AND SERVICES. (a) The
3642 college [institute] shall offer, but is not limited to offering,
3743 the following courses, programs, and services for hearing-impaired
3844 post-secondary students:
3945 (1) learning development services, including academic
4046 counseling, tutorial services, reading instruction, services to
4147 counter learning disabilities, and library-related services;
4248 (2) communications services, including interpreters
4349 for academic and nonacademic functions, speech therapy, and
4450 auditory evaluation and training;
4551 (3) academic college preparatory courses;
4652 (4) career analysis services designed to assist each
4753 student in identifying a career interest, considering the student's
4854 aptitudes, abilities, and skills;
4955 (5) regular college courses, including vocational and
5056 technical education and liberal arts courses;
5157 (6) extracurricular activities, including intramural
5258 athletics; and
5359 (7) postgraduation services, including job placement
5460 services and services designed to orient employers to
5561 hearing-impaired workers.
5662 (b) The course work offered by the college [institute] shall
5763 emphasize self-contained classrooms with instruction conducted by
5864 instructors who are trained and qualified to work with
5965 hearing-impaired students and are fluent in manual communication
6066 skills. Hearing-impaired students may enroll in integrated classes
6167 that are regular classes offered to students with unimpaired
6268 hearing enrolled in the junior college.
6369 (c) The programs, services, and facilities of the college
6470 [institute] shall be designed to be appropriate to the needs of
6571 hearing-impaired students.
6672 (d) The executive director shall determine which courses
6773 offered by the college [institute] are appropriate for an
6874 electronic display on a screen or terminal, with less than 30
6975 seconds delay, of a speaker's spoken message. The college
7076 [institute] shall implement the electronic display in those
7177 courses.
7278 Sec. 131.005. TUITION. (a) A Texas resident student
7379 enrolled in the college [institute] is exempt from tuition fees
7480 under Section 54.364.
7581 (b) A student who is not a resident of Texas shall pay
7682 tuition at a rate that is the lesser of:
7783 (1) the rate provided by this code for a nonresident
7884 student enrolled at a general academic teaching institution; or
7985 (2) a rate determined by the board of trustees and the
8086 Texas Higher Education Coordinating Board[, Texas College and
8187 University System] to be the approximate cost to the college
8288 [institute], not including room and board, of educating a student
8389 during the academic year beginning the next fall.
8490 Sec. 131.006. APPROPRIATIONS; GRANTS. (a) The governing
8591 board of the college [institute] may receive appropriations for the
8692 college's [institute's] operations only if the board operates the
8793 college [institute] in compliance with this chapter.
8894 (b) The board may accept gifts, grants, or donations of
8995 money or property given to the college [institute] for the
9096 college's [institute's] exclusive use in carrying out the purposes
9197 of this subchapter.
9298 (c) The board may expend appropriated funds for maintenance
9399 and operation, including the maintenance and operation of student
94100 housing and food service, unless the funds are specifically
95101 restricted to another purpose by the appropriation.
96102 SECTION 2. Section 51.911(a)(1), Education Code, is amended
97103 to read as follows:
98104 (1) "Institution of higher education" has the meaning
99105 assigned by [Subdivision (7) of] Section 61.003 of this code, but
100106 includes the Southwest College [Collegiate Institute] for the Deaf
101107 and Texas State Technical College System [Institute].
102108 SECTION 3. Section 51.925(b), Education Code, is amended to
103109 read as follows:
104110 (b) In this section, "institution of higher education" has
105111 the meaning assigned by [Subdivision (7) of] Section 61.003 of this
106112 code, except that the term includes the Southwest College
107113 [Collegiate Institute] for the Deaf and Texas State Technical
108114 College System [Institute].
109115 SECTION 4. Section 54.364(a)(5), Education Code, is amended
110116 to read as follows:
111117 (5) "Institution of higher education" has the meaning
112118 assigned by Section 61.003, except that the term includes the
113119 Southwest College [Collegiate Institute] for the Deaf.
114120 SECTION 5. Section 31.001(8), Natural Resources Code, is
115121 amended to read as follows:
116122 (8) "Institution of higher education" means the Texas
117123 State Technical College System, the Southwest College [Collegiate
118124 Institute] for the Deaf, or an institution of higher education,
119125 excluding a public junior college, as defined by Section 61.003,
120126 Education Code.
121127 SECTION 6. (a) The name of the Southwest Collegiate
122128 Institute for the Deaf is changed to the Southwest College for the
123129 Deaf.
124130 (b) A reference in law to the Southwest Collegiate Institute
125131 for the Deaf means the Southwest College for the Deaf.
126132 (c) An appropriation for the use or benefit of the Southwest
127133 Collegiate Institute for the Deaf is available for the use and
128134 benefit of the Southwest College for the Deaf.
129135 SECTION 7. This Act takes effect September 1, 2019.
