| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter C, Chapter 1053, Special District |
|---|
| 11 | 11 | | Local Laws Code, is amended by adding Section 1053.113 to read as |
|---|
| 12 | 12 | | follows: |
|---|
| 13 | 13 | | Sec. 1053.113. EMPLOYMENT OF DISTRICT PEACE OFFICERS. (a) |
|---|
| 14 | 14 | | The board may employ and commission peace officers for the |
|---|
| 15 | 15 | | district. |
|---|
| 16 | 16 | | (b) The jurisdiction of a peace officer commissioned under |
|---|
| 17 | 17 | | this section includes the property owned or controlled by the |
|---|
| 18 | 18 | | district. |
|---|
| 19 | 19 | | (c) In a district peace officer's jurisdiction, the peace |
|---|
| 20 | 20 | | officer has the authority granted by Chapter 14, Code of Criminal |
|---|
| 21 | 21 | | Procedure. |
|---|
| 22 | 22 | | SECTION 2. Article 2.12, Code of Criminal Procedure, is |
|---|
| 23 | 23 | | amended to read as follows: |
|---|
| 24 | 24 | | Art. 2.12. WHO ARE PEACE OFFICERS. The following are peace |
|---|
| 25 | 25 | | officers: |
|---|
| 26 | 26 | | (1) sheriffs, their deputies, and those reserve |
|---|
| 27 | 27 | | deputies who hold a permanent peace officer license issued under |
|---|
| 28 | 28 | | Chapter 1701, Occupations Code; |
|---|
| 29 | 29 | | (2) constables, deputy constables, and those reserve |
|---|
| 30 | 30 | | deputy constables who hold a permanent peace officer license issued |
|---|
| 31 | 31 | | under Chapter 1701, Occupations Code; |
|---|
| 32 | 32 | | (3) marshals or police officers of an incorporated |
|---|
| 33 | 33 | | city, town, or village, and those reserve municipal police officers |
|---|
| 34 | 34 | | who hold a permanent peace officer license issued under Chapter |
|---|
| 35 | 35 | | 1701, Occupations Code; |
|---|
| 36 | 36 | | (4) rangers, officers, and members of the reserve |
|---|
| 37 | 37 | | officer corps commissioned by the Public Safety Commission and the |
|---|
| 38 | 38 | | Director of the Department of Public Safety; |
|---|
| 39 | 39 | | (5) investigators of the district attorneys', criminal |
|---|
| 40 | 40 | | district attorneys', and county attorneys' offices; |
|---|
| 41 | 41 | | (6) law enforcement agents of the Texas Alcoholic |
|---|
| 42 | 42 | | Beverage Commission; |
|---|
| 43 | 43 | | (7) each member of an arson investigating unit |

|---|
| 60 | 60 | | security officers; |

| 61 | 61 | | (14) security officers and investigators commissioned |
|---|
| 62 | 62 | | as peace officers by the comptroller; |
|---|
| 63 | 63 | | (15) officers commissioned by a water control and |
|---|
| 64 | 64 | | improvement district under Section 49.216, Water Code; |

| 127 | 127 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 128 | 128 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 129 | 129 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 130 | 130 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 131 | 131 | | Act takes effect September 1, 2019. |
