66 AN ACT
77 relating to consent instruction and instruction on the prevention
88 of sexual abuse and sex trafficking for certain public school
99 students.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter A, Chapter 28, Education Code, is
1212 amended by adding Section 28.0045 to read as follows:
1313 Sec. 28.0045. CONSENT INSTRUCTION. (a) A school district
1414 shall include in the district's health curriculum for students in
1515 kindergarten through fifth grade instruction on the importance of
1616 obtaining a person's consent before engaging in any physical
1717 activity with that person.
1818 (b) The State Board of Education shall adopt the essential
1919 knowledge and skills for age-appropriate curricula to be used by a
2020 school district in providing consent instruction under this
2121 section.
2222 (c) A school district shall ensure that each student in
2323 kindergarten through fifth grade receives consent instruction
2424 under this section at least once in each grade level, unless the
2525 student's parent removes the student from the instruction for the
2626 applicable grade level.
2727 (d) Before the beginning of each school year, a school
2828 district shall provide to the parent of each student enrolled in the
2929 district in kindergarten through fifth grade written notice that
3030 includes:
3131 (1) a statement that the district will provide consent
3232 instruction as provided by this section to students in the
3333 applicable grade level;
3434 (2) a description of the material that will be used in
3535 providing instruction to those students; and
3636 (3) a statement that the parent has the right to review
3737 the material and remove the parent's student from the instruction.
3838 SECTION 2. Section 28.017, Education Code, as added by
3939 Chapter 762 (S.B. 2039), Acts of the 85th Legislature, Regular
4040 Session, 2017, is reenacted and amended to read as follows:
4141 Sec. 28.017. INSTRUCTION ON PREVENTION OF SEXUAL ABUSE AND
4242 SEX TRAFFICKING. (a) The commissioner, in cooperation with [the
4343 human trafficking prevention task force created under Section
4444 402.035, Government Code, and] any [other] persons the commissioner
4545 considers appropriate, shall develop one or more sexual abuse and
4646 sex trafficking instructional modules for use by [that] a school
4747 district as provided by this section [may use in the district's
4848 health curriculum]. The modules may include:
4949 (1) information on the different forms of sexual abuse
5050 and assault, sex trafficking, and risk factors for sex trafficking;
5151 (2) the procedures for reporting sexual abuse and sex
5252 trafficking or suspected sexual abuse or sex trafficking;
5353 (3) strategies for sexual abuse and assault prevention
5454 and overcoming peer pressure;
5555 (4) information on establishing healthy boundaries
5656 for relationships, recognizing potentially abusive or harmful
5757 relationships, and avoiding high-risk activities;
5858 (5) the recruiting tactics of sex traffickers and peer
5959 recruiters, including recruitment through the Internet;
6060 (6) the legal aspects of sexual abuse and sex
6161 trafficking under state and federal law; and
6262 (7) the influence of culture and mass media on
6363 perceptions of sexual abuse and sex trafficking, including
6464 stereotypes and myths about victims and abusers, victim blaming,
6565 and the role of language.
6666 (a-1) As age-appropriate, a school district:
6767 (1) shall use the modules developed under Subsection
6868 (a) in the district's health curriculum for students in grade
6969 levels 6 through 12; and
7070 (2) may use those modules in the district's health
7171 curriculum for students not described by Subdivision (1).
7272 (a-2) A school district shall ensure that each student in
7373 grade levels 9 through 12 receives age-appropriate instruction
7474 using the modules developed under Subsection (a) at least once in
7575 each grade level, unless the student's parent removes the student
7676 from the instruction for the applicable grade level.
7777 (b) The module or modules developed under Subsection (a)
7878 must emphasize compassion for victims of sexual abuse or sex
7979 trafficking and the creation of a positive reentry experience for
8080 survivors of sexual abuse or sex trafficking into schools.
8181 (c) Before the beginning of each school year, a school
8282 district [that elects to use a module developed under Subsection
8383 (a) in the district's health curriculum] shall provide [written
8484 notice] to the parent of each student enrolled in the district in a
8585 grade level for which a module developed under Subsection (a) will
8686 be used written notice that includes [the following]:
8787 (1) a statement that the district will provide
8888 instruction relating to sexual abuse and sex trafficking awareness
8989 to students in the applicable grade level [enrolled in the
9090 district];
9191 (2) a description of the material that will be used in
9292 providing instruction to those students; and
9393 (3) a statement that the parent has the right to review
9494 the material and remove the parent's student from the instruction.
9595 (d) If a school district does not comply with the
9696 requirements of Subsection (c), a parent of a student enrolled in
9797 the district may file a complaint in accordance with the district's
9898 grievance procedure developed under Section 26.011.
9999 SECTION 3. This Act applies beginning with the 2020-2021
100100 school year.
101101 SECTION 4. This Act takes effect September 1, 2019.
