7 | 7 | | relating to the continuation and functions of the State Office of |

8 | 8 | | Risk Management. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subchapter B, Chapter 412, Labor Code, is |
---|
11 | 11 | | amended by adding Section 412.013 to read as follows: |
---|
12 | 12 | | Sec. 412.013. REVIEW AND UPDATE OF RISK MANAGEMENT PROGRAM |
---|
13 | 13 | | GUIDELINES. (a) In administering the guidelines for a |
---|
14 | 14 | | comprehensive risk management program under Section 412.011(b)(4), |
---|
15 | 15 | | the office must: |
---|
16 | 16 | | (1) at least biennially review the guidelines to |
---|
17 | 17 | | determine whether they are appropriate and current; and |
---|
18 | 18 | | (2) at least every five years, update the guidelines |
---|
19 | 19 | | to be consistent with up-to-date industry best practices and |
---|
20 | 20 | | current law. |
---|
21 | 21 | | (b) In updating the guidelines under Subsection (a)(2), the |
---|
22 | 22 | | office must solicit feedback from state entities concerning topics |
---|
23 | 23 | | for inclusion in the guidelines and ways for making the guidelines |
---|
24 | 24 | | more user-friendly. |
---|
25 | 25 | | SECTION 2. Section 412.021(f), Labor Code, is amended to |
---|
26 | 26 | | read as follows: |
---|
27 | 27 | | (f) The risk management board and the office are subject to |
---|
28 | 28 | | Chapter 325, Government Code (Texas Sunset Act). Unless continued |
---|
29 | 29 | | in existence as provided by that chapter, the board is abolished and |
---|
30 | 30 | | this section expires September 1, 2031 [2019]. |
---|
31 | 31 | | SECTION 3. Section 412.022, Labor Code, is amended by |
---|
32 | 32 | | amending Subsection (b) and adding Subsection (d) to read as |
---|
33 | 33 | | follows: |
---|
34 | 34 | | (b) The [A] training program [established under this |
---|
35 | 35 | | section] must provide the board member with information [to the |
---|
36 | 36 | | member] regarding: |
---|
37 | 37 | | (1) the law governing [enabling legislation that |
---|
38 | 38 | | created the office and] the office's operations; |
---|
39 | 39 | | (2) the programs, functions, rules, and budget of the |
---|
40 | 40 | | office; |
---|
41 | 41 | | (3) the scope of and limitations on the rulemaking |
---|
42 | 42 | | authority of the board; |
---|
43 | 43 | | (4) [(2)] the results of the most recent formal audit |
---|
44 | 44 | | of the office; |
---|
45 | 45 | | (5) [(3)] the requirements of: |
---|
46 | 46 | | (A) laws relating to open meetings, public |
---|
47 | 47 | | information, administrative procedure, and disclosing conflicts of |
---|
48 | 48 | | interest; and |
---|
49 | 49 | | (B) other laws applicable to members of a state |
---|
50 | 50 | | policymaking body in performing their duties; and |
---|
51 | 51 | | (6) [(4)] any applicable ethics policies adopted by |
---|
52 | 52 | | the office or the Texas Ethics Commission. |
---|
53 | 53 | | (d) The director of the office shall create a training |
---|
54 | 54 | | manual that includes the information required by Subsection (b). |
---|
55 | 55 | | The director shall distribute a copy of the training manual |
---|
56 | 56 | | annually to each member of the board. Each member of the board |
---|
57 | 57 | | shall sign and submit to the director a statement acknowledging |
---|
58 | 58 | | that the member received and has reviewed the training manual. |
---|
59 | 59 | | SECTION 4. Section 412.053(b), Labor Code, is amended to |
---|
60 | 60 | | read as follows: |
---|
61 | 61 | | (b) The information shall be reported not later than the |
---|
62 | 62 | | 60th day after [before] the last day of each fiscal year. |
---|
63 | 63 | | SECTION 5. Notwithstanding the time periods prescribed by |
---|
64 | 64 | | Section 412.013, Labor Code, as added by this Act, the State Office |
---|
65 | 65 | | of Risk Management shall review and update the guidelines adopted |
---|
66 | 66 | | by the risk management board under Section 412.011(b)(4), Labor |
---|
67 | 67 | | Code, not later than September 1, 2020. |
---|
68 | 68 | | SECTION 6. (a) Except as provided by Subsection (b) of this |
---|
69 | 69 | | section, Section 412.022, Labor Code, as amended by this Act, |
---|
70 | 70 | | applies to a member of the risk management board appointed before, |
---|
71 | 71 | | on, or after the effective date of this Act. |
---|
72 | 72 | | (b) A member of the risk management board who, before the |
---|
73 | 73 | | effective date of this Act, completed the training program required |
---|
74 | 74 | | by Section 412.022, Labor Code, as that law existed before the |
---|
75 | 75 | | effective date of this Act, is required to complete additional |
---|
76 | 76 | | training only on subjects added by this Act to the training program |
---|
77 | 77 | | as required by Section 412.022, Labor Code, as amended by this Act. |
---|
78 | 78 | | A board member described by this subsection may not vote, |
---|
79 | 79 | | deliberate, or be counted as a member in attendance at a meeting of |
---|
80 | 80 | | the board held on or after December 1, 2019, until the member |
---|
81 | 81 | | completes the additional training. |
---|
82 | 82 | | SECTION 7. This Act takes effect September 1, 2019. |
