| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Subchapter C, Chapter 112, Transportation Code, | |
| 11 | 11 | is amended by adding Section 112.104 to read as follows: | |
| 12 | 12 | Sec. 112.104. COUNTY REGULATION OF HIGH-SPEED RAIL ACTIVITY | |
| 13 | 13 | NEAR SCHOOLS. In the interest of safety, a county by order may | |
| 14 | 14 | regulate operations and activities in the unincorporated area of | |
| 15 | 15 | the county related to high-speed rail, as defined by Section | |
| 16 | 16 | 112.201, that occur within five miles of the campus of an elementary | |
| 17 | 17 | or secondary school, day-care center, preschool, or institution of | |
| 18 | 18 | higher education. | |
| 19 | 19 | SECTION 2. This Act takes effect September 1, 2019. |
