A BILL TO BE ENTITLED
AN ACT
relating to regulation in the unincorporated area of a county of
high-speed rail activity near schools.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter C, Chapter 112, Transportation Code,
is amended by adding Section 112.104 to read as follows:
Sec. 112.104. COUNTY REGULATION OF HIGH-SPEED RAIL ACTIVITY
NEAR SCHOOLS. In the interest of safety, a county by order may
regulate operations and activities in the unincorporated area of
the county related to high-speed rail, as defined by Section
112.201, that occur within five miles of the campus of an elementary
or secondary school, day-care center, preschool, or institution of
higher education.
SECTION 2. This Act takes effect September 1, 2019.
