86 AN ACT
9- relating to the development of a dental services benefit under
10- Medicaid for adult recipients with disabilities and a pilot program
11- to provide those services.
7+ relating to Medicaid reimbursement for dental services provided to
8+ adults with disabilities.
129 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
13- SECTION 1. Subchapter B, Chapter 32, Human Resources Code,
14- is amended by adding Section 32.0545 to read as follows:
15- Sec. 32.0545. DENTAL SERVICES BENEFIT FOR CERTAIN
16- RECIPIENTS; PILOT PROGRAM. (a) The commission shall develop a
17- dental services benefit under the medical assistance program for
18- adult recipients with disabilities. The dental services benefit
19- must be:
20- (1) cost-effective and designed to achieve cost
21- savings;
22- (2) designed to reduce emergency room visits by or
23- hospitalizations of adult recipients with disabilities resulting
24- from a lack of access to dental services; and
25- (3) designed to meet the individual needs of adult
26- recipients with disabilities.
27- (b) In developing the dental services benefit under this
28- section, the commission shall evaluate dental services benefits
29- provided under medical assistance waiver programs authorized under
30- Section 1115 of the federal Social Security Act (42 U.S.C. Section
31- 1315) and dental services benefits provided as a value-added
32- service under the Medicaid managed care delivery model.
33- (c) Not later than September 1, 2020, the commission shall
34- prepare and submit to the legislature a written report on the dental
35- services benefit developed under this section.
36- (d) The commission may establish and operate a pilot program
37- to provide the dental services benefit developed under this section
38- in one or more geographic areas of this state. The pilot program
39- must conclude not later than September 1, 2022. If the commission
40- establishes the pilot program under this section, the commission
41- shall prepare and submit to the legislature a written report that
42- summarizes the results of the pilot program not later than December
43- 1, 2022.
44- (e) This section expires September 1, 2023.
10+ SECTION 1. Section 32.054, Human Resources Code, is amended
11+ by adding Subsection (f) to read as follows:
12+ (f) The commission shall provide medical assistance
13+ reimbursement for dental services, including preventive dental
14+ services, for an adult recipient with a disability to prevent
15+ serious medical conditions and reduce emergency room visits by the
16+ recipient necessitated by complications resulting from a lack of
17+ access to dental care.
4518 SECTION 2. If before implementing any provision of this Act
4619 a state agency determines that a waiver or authorization from a
4720 federal agency is necessary for implementation of that provision,
4821 the agency affected by the provision shall request the waiver or
4922 authorization and may delay implementing that provision until the
5023 waiver or authorization is granted.
5124 SECTION 3. This Act takes effect September 1, 2019.
