| 10 | 10 | SECTION 1. Subchapter B, Chapter 222, Transportation Code, | |
| 11 | 11 | is amended by adding Section 222.036 to read as follows: | |
| 12 | 12 | Sec. 222.036. DESIGNATION OF CERTAIN FUNDS FOR BORDER | |
| 13 | 13 | INFRASTRUCTURE PROJECTS. As authorized by the Fixing America's | |
| 14 | 14 | Surface Transportation Act (Pub. L. No. 114-94) or other similar | |
| 15 | 15 | federal law, the governor shall, each fiscal year, designate at | |
| 16 | 16 | least five percent of funds available to this state under 23 U.S.C. | |
| 17 | 17 | Section 133(d)(1)(B) for border infrastructure projects. | |
| 18 | 18 | SECTION 2. This Act takes effect immediately if it receives | |
| 19 | 19 | a vote of two-thirds of all the members elected to each house, as | |
| 20 | 20 | provided by Section 39, Article III, Texas Constitution. If this | |
| 21 | 21 | Act does not receive the vote necessary for immediate effect, this | |
| 22 | 22 | Act takes effect September 1, 2019. |
