 A BILL TO BE ENTITLED
 AN ACT
 relating to the designation of certain federal funds for border
 infrastructure projects.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Subchapter B, Chapter 222, Transportation Code,
 is amended by adding Section 222.036 to read as follows:
 Sec. 222.036.  DESIGNATION OF CERTAIN FUNDS FOR BORDER
 INFRASTRUCTURE PROJECTS. As authorized by the Fixing America's
 Surface Transportation Act (Pub. L. No. 114-94) or other similar
 federal law, the governor shall, each fiscal year, designate at
 least five percent of funds available to this state under 23 U.S.C.
 Section 133(d)(1)(B) for border infrastructure projects.
 SECTION 2.  This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution.  If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2019.
