66 AN ACT
77 relating to annual applications for ballots to be voted by mail.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 86.0015, Election Code, is amended by
1010 amending Subsection (b) and adding Subsection (b-3) to read as
1111 follows:
1212 (b) An application described by Subsection (a) is
1313 considered to be an application for a ballot for each election,
1414 including any ensuing runoff:
1515 (1) in which the applicant is eligible to vote; and
1616 (2) that occurs before the earlier of:
1717 (A) except as provided by Subsection (b-2) or
1818 (b-3), the end of the calendar year in which the application was
1919 submitted;
2020 (B) the date the county clerk receives notice
2121 from the voter registrar under Subsection (f) that the voter has
2222 changed residence to another county; or
2323 (C) the date the voter's registration is
2424 canceled.
2525 (b-3) An application is considered to be submitted for the
2626 year in which the application is submitted and the following
2727 calendar year for purposes of this section if:
2828 (1) the first election in which the applicant is
2929 eligible to vote following the submission of the application is an
3030 election held on the uniform election date in November of an
3131 odd-numbered year; and
3232 (2) the applicant indicates that the application is
3333 for the next November election and the elections held in the
3434 following calendar year.
3535 SECTION 2. This Act takes effect immediately if it receives
3636 a vote of two-thirds of all the members elected to each house, as
3737 provided by Section 39, Article III, Texas Constitution. If this
3838 Act does not receive the vote necessary for immediate effect, this
3939 Act takes effect September 1, 2019.
