| 7 | 7 | | relating to annual applications for ballots to be voted by mail. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 86.0015, Election Code, is amended by |
|---|
| 10 | 10 | | amending Subsection (b) and adding Subsection (b-3) to read as |
|---|
| 11 | 11 | | follows: |
|---|
| 12 | 12 | | (b) An application described by Subsection (a) is |
|---|
| 13 | 13 | | considered to be an application for a ballot for each election, |
|---|
| 14 | 14 | | including any ensuing runoff: |
|---|
| 15 | 15 | | (1) in which the applicant is eligible to vote; and |
|---|
| 16 | 16 | | (2) that occurs before the earlier of: |
|---|
| 17 | 17 | | (A) except as provided by Subsection (b-2) or |
|---|
| 18 | 18 | | (b-3), the end of the calendar year in which the application was |
|---|
| 19 | 19 | | submitted; |
|---|
| 20 | 20 | | (B) the date the county clerk receives notice |
|---|
| 21 | 21 | | from the voter registrar under Subsection (f) that the voter has |
|---|
| 22 | 22 | | changed residence to another county; or |
|---|
| 23 | 23 | | (C) the date the voter's registration is |
|---|
| 24 | 24 | | canceled. |
|---|
| 25 | 25 | | (b-3) An application is considered to be submitted for the |
|---|
| 26 | 26 | | year in which the application is submitted and the following |
|---|
| 27 | 27 | | calendar year for purposes of this section if: |
|---|
| 28 | 28 | | (1) the first election in which the applicant is |
|---|
| 29 | 29 | | eligible to vote following the submission of the application is an |
|---|
| 30 | 30 | | election held on the uniform election date in November of an |
|---|
| 31 | 31 | | odd-numbered year; and |
|---|
| 32 | 32 | | (2) the applicant indicates that the application is |
|---|
| 33 | 33 | | for the next November election and the elections held in the |
|---|
| 34 | 34 | | following calendar year. |
|---|
| 35 | 35 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 36 | 36 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 37 | 37 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 38 | 38 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 39 | 39 | | Act takes effect September 1, 2019. |
