7 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 14 | | SECTION 1. Section 1.34, Chapter 626, Acts of the 73rd |
---|
9 | 15 | | Legislature, Regular Session, 1993, is amended by amending |
---|
10 | 16 | | Subsection (a) and adding Subsections (a-1), (a-2), and (a-3) to |
---|
11 | 17 | | read as follows: |
---|
12 | 18 | | (a) In this section, "retail public utility" has the meaning |
---|
13 | 19 | | assigned by Chapter 13, Water Code. |
---|
14 | 20 | | (a-1) Except as provided by this section, water [Water] |
---|
15 | 21 | | withdrawn from the aquifer must be used within the boundaries of the |
---|
16 | 22 | | authority. |
---|
17 | 23 | | (a-2) A retail public utility that is an initial regular |
---|
18 | 24 | | permit holder and the service area of which is contained wholly or |
---|
19 | 25 | | partly inside the boundaries of the authority may use water |
---|
20 | 26 | | withdrawn from the aquifer to provide retail water service in a |
---|
21 | 27 | | county adjacent to the boundaries of the authority within the |
---|
22 | 28 | | utility's certificated service area. |
---|
23 | 29 | | (a-3) A municipally owned utility owned by the City of San |
---|
24 | 30 | | Antonio may sell not more than 6,000 acre feet of water withdrawn |
---|
25 | 31 | | from the aquifer per year at wholesale to a retail public utility or |
---|
26 | 32 | | river authority for use in any county adjacent to Bexar County. The |
---|
27 | 33 | | municipally owned utility owned by the City of San Antonio must |
---|
28 | 34 | | obtain the consent of the Kendall County Commissioners Court for a |
---|
29 | 35 | | sale of water under this subsection if: |
---|
30 | 36 | | (1) the water is sold for use in Kendall County; and |
---|
31 | 37 | | (2) the sale would cause the total sales of water under |
---|
32 | 38 | | this subsection for use in Kendall County to exceed 1,500 acre feet |
---|
33 | 39 | | of water per year. |
---|
34 | 40 | | SECTION 2. This Act takes effect September 1, 2019. |
