9+ A BILL TO BE ENTITLED
410 AN ACT
511 relating to the use of water withdrawn from the Edwards Aquifer by
612 certain entities.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Section 1.34, Chapter 626, Acts of the 73rd
915 Legislature, Regular Session, 1993, is amended by amending
1016 Subsection (a) and adding Subsections (a-1), (a-2), and (a-3) to
1117 read as follows:
1218 (a) In this section, "retail public utility" has the meaning
1319 assigned by Chapter 13, Water Code.
1420 (a-1) Except as provided by this section, water [Water]
1521 withdrawn from the aquifer must be used within the boundaries of the
1622 authority.
1723 (a-2) A retail public utility that is an initial regular
1824 permit holder and the service area of which is contained wholly or
1925 partly inside the boundaries of the authority may use water
2026 withdrawn from the aquifer to provide retail water service in a
2127 county adjacent to the boundaries of the authority within the
2228 utility's certificated service area.
2329 (a-3) A municipally owned utility owned by the City of San
2430 Antonio may sell not more than 6,000 acre feet of water withdrawn
2531 from the aquifer per year at wholesale to a retail public utility or
2632 river authority for use in any county adjacent to Bexar County. The
2733 municipally owned utility owned by the City of San Antonio must
2834 obtain the consent of the Kendall County Commissioners Court for a
2935 sale of water under this subsection if:
3036 (1) the water is sold for use in Kendall County; and
3137 (2) the sale would cause the total sales of water under
3238 this subsection for use in Kendall County to exceed 1,500 acre feet
3339 of water per year.
3440 SECTION 2. This Act takes effect September 1, 2019.
