9	7		relating to a state plan for education on and treatment of
10	8		Alzheimer's disease and related disorders.
11	9		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	10		SECTION 1. Subtitle D, Title 2, Health and Safety Code, is
13	11		amended by adding Chapter 99 to read as follows:
14	12		CHAPTER 99. STATE PLAN FOR ALZHEIMER'S DISEASE AND RELATED
15	13		DISORDERS
16	14		Sec. 99.001. DEVELOPMENT AND IMPLEMENTATION OF STATE PLAN.
17	15		(a) The department, using existing resources and programs to the
18	16		extent possible, shall develop and implement a state plan for
19	17		education on and treatment of Alzheimer's disease and related
20	18		disorders.
21		-	(b) The state plan must include strategies for:

23	22		onset risks for, and improving treatment of Alzheimer's disease and
24	23		related disorders for specific demographic groups;

27	26		related disorders;
28	27		(3) providing caregiver support;
29	28		(4) advancing basic science and applied research
30	29		related to Alzheimer's disease and related disorders; and
31	30		(5) collecting and evaluating information on efforts
32	31		to prevent and treat Alzheimer's disease and related disorders.
33		-	(c) The department shall develop the strategies described
34		-	by Subsection (b)(1) in consultation with physicians and other
35		-	health care providers licensed in this state who have clinical
36		-	training and experience in caring for persons with Alzheimer's
37		-	disease or related disorders.
38		-	Sec. 99.002. NO CAUSE OF ACTION, DUTY, STANDARD OF CARE, OR
39		-	LIABILITY CREATED. Notwithstanding any other law, Section 99.001,
40		-	including the use of or failure to use any information or materials
41		-	developed or disseminated under that section, does not create a
42		-	civil, criminal, or administrative cause of action or liability or
43		-	create a standard of care, obligation, or duty that provides a basis
44		-	for a cause of action.
45		-	Sec. 99.003. COMMENTS FROM INTERESTED PARTIES. (a) In

47	34		shall seek comments from interested parties, including:
48	35		(1) members of the public with, or who care for persons

52	39		(3) any advisory body that addresses issues related to
53	40		Alzheimer's disease or related disorders;
54	41		(4) public advocates concerned with issues related to
55	42		Alzheimer's disease or related disorders;
56		-	(5) physicians and health care providers licensed in
57		-	this state who have clinical training and experience in caring for

59	45		(6) researchers of issues affecting persons with
60	46		Alzheimer's disease or related disorders.
61	47		(b) On request of the department, the commission shall
62	48		provide information and comments related to services provided to
63	49		persons with Alzheimer's disease or related disorders.
64	50		(c) The department shall meet with interested parties at
65	51		least two times each year to:
66	52		(1) facilitate comments on and discuss the progress of
67		-	developing and implementing the state plan under this chapter; and

68	55		(2) gather information for the report required under
69		-	Section 99.~~005~~.

72	59		plan developed under this chapter at least once every five years.
