66 AN ACT
77 relating to workforce and succession planning by state agencies.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 321, Government Code, is amended by
1010 adding Section 321.024 to read as follows:
1111 Sec. 321.024. STATE AGENCY'S WORKFORCE AND SUCCESSION PLAN.
1212 (a) In this section, "state agency" has the meaning assigned by
1313 Section 2056.001.
1414 (b) The State Auditor shall include in the State Auditor's
1515 annual report on classified employee turnover:
1616 (1) a list of each state agency that has submitted the
1717 workforce and succession plan under Section 2056.0021 and each
1818 state agency that has failed to submit a plan under that section;
1919 and
2020 (2) a thorough and comprehensive summary of the types
2121 and extent of workforce and succession planning completed by state
2222 agencies.
2323 SECTION 2. Section 2056.0021, Government Code, is amended
2424 to read as follows:
2525 Sec. 2056.0021. WORKFORCE AND SUCCESSION PLANNING. (a) As
2626 part of the strategic plan required under Section 2056.002, a state
2727 agency shall conduct a strategic staffing analysis and develop a
2828 workforce and succession plan, according to guidelines developed by
2929 the state auditor, to address critical staffing and training needs
3030 of the agency, including the need for experienced employees to
3131 impart knowledge to their potential successors.
3232 (b) The workforce and succession plan developed by a state
3333 agency under Subsection (a) must include:
3434 (1) provisions that:
3535 (A) identify and develop mechanisms to ensure the
3636 transfer of institutional knowledge from experienced and retiring
3737 employees who are not appointed by the governor or the governing
3838 body of the state agency to succeeding employees; and
3939 (B) identify the skills and abilities necessary
4040 for the development of the succeeding employees; and
4141 (2) a report on the implementation of the mechanisms,
4242 skills, and abilities identified and developed in the previous
4343 workforce and succession plan.
4444 (c) A state agency shall include in the state agency's
4545 legislative appropriations request a provision stating whether the
4646 state agency has developed a workforce and succession plan as
4747 required by this section.
4848 SECTION 3. This Act takes effect September 1, 2019.
