55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a study regarding the costs of educating educationally
88 disadvantaged students and students of limited English proficiency
99 in public schools.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 29, Education Code, is
1212 amended by adding Section 29.067 to read as follows:
1313 Sec. 29.067. STUDY REGARDING COSTS OF EDUCATING
1414 EDUCATIONALLY DISADVANTAGED STUDENTS AND STUDENTS OF LIMITED
1515 ENGLISH PROFICIENCY; REPORT. (a) The agency shall conduct a study
1616 to examine the costs of educating a student who is educationally
1717 disadvantaged and a student of limited English proficiency in
1818 public schools. The study must:
1919 (1) determine whether the compensatory education
2020 allotment under Section 42.152 provides adequate funding to schools
2121 for meeting the educational needs of students who are educationally
2222 disadvantaged;
2323 (2) if it is determined under Subdivision (1) that the
2424 compensatory education allotment is inadequate, determine the
2525 amount of adjustment for the compensatory education allotment that
2626 would provide adequate funding to schools for meeting the
2727 educational needs of students who are educationally disadvantaged;
2828 (3) determine whether the bilingual education
2929 allotment under Section 42.153 provides adequate funding to schools
3030 for meeting the educational needs of students of limited English
3131 proficiency; and
3232 (4) if it is determined under Subdivision (3) that the
3333 bilingual education allotment is inadequate, determine the amount
3434 of adjustment for the bilingual education allotment that would
3535 provide adequate funding to schools for meeting the educational
3636 needs of students of limited English proficiency.
3737 (b) Not later than January 1, 2020, the agency shall prepare
3838 a report detailing the results of the study under this section and
3939 submit the report to each standing legislative committee with
4040 primary jurisdiction over primary and secondary education.
4141 (c) This section expires September 1, 2020.
4242 SECTION 2. This Act takes effect immediately if it receives
4343 a vote of two-thirds of all the members elected to each house, as
4444 provided by Section 39, Article III, Texas Constitution. If this
4545 Act does not receive the vote necessary for immediate effect, this
4646 Act takes effect September 1, 2019.
