66 AN ACT
77 relating to a study by the Texas A&M Transportation Institute on the
88 collection of road use fees from owners of alternatively fueled
99 vehicles.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. DEFINITIONS. In this Act:
1212 (1) "Alternatively fueled vehicle" means a motor
1313 vehicle that is capable of using a fuel other than gasoline or
1414 conventional diesel fuel.
1515 (2) "Traditionally fueled vehicle" means a motor
1616 vehicle that uses gasoline or conventional diesel fuel as its
1717 source of motor power.
1818 SECTION 2. STUDY AND REPORT. (a) The Texas A&M
1919 Transportation Institute shall conduct a study on:
2020 (1) the impacts of the alternatively fueled vehicle
2121 industry on this state; and
2222 (2) the options available to the state for collecting
2323 road use fees from owners of alternatively fueled vehicles.
2424 (b) The study must examine:
2525 (1) the current revenue generated from motor fuel
2626 taxes imposed under Chapter 162, Tax Code, on a traditionally
2727 fueled vehicle for each mile the vehicle is operated;
2828 (2) the net revenue generated by fees and taxes paid by
2929 owners of alternatively fueled vehicles and traditionally fueled
3030 vehicles for the use of the vehicle, including motor vehicle
3131 registration fees under Chapter 502, Transportation Code, and motor
3232 fuel taxes under Chapter 162, Tax Code;
3333 (3) the average number of miles traveled by
3434 alternatively fueled vehicles and traditionally fueled vehicles
3535 each year;
3636 (4) the methods by which other states generate revenue
3737 from alternatively fueled vehicles;
3838 (5) alternative methods for determining and
3939 collecting road use fees from owners of alternatively fueled
4040 vehicles, including methods that consider the weight of and the
4141 number of miles traveled by an alternatively fueled vehicle;
4242 (6) the projected revenue to the state for each method
4343 examined under Subdivision (5) of this subsection; and
4444 (7) the projected environmental impact of
4545 alternatively fueled vehicles on this state.
4646 (c) Not later than December 1, 2020, the Texas A&M
4747 Transportation Institute shall submit to the legislature a report
4848 on the findings of the study conducted under this section.
4949 SECTION 3. EXPIRATION. This Act expires January 1, 2021.
5050 SECTION 4. EFFECTIVE DATE. This Act takes effect September
5151 1, 2019.
