| 7 | 7 | | relating to the training requirements for and the expiration of a |
|---|
| 8 | 8 | | school marshal license issued or renewed by the Texas Commission on |
|---|
| 9 | 9 | | Law Enforcement. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 1701.260, Occupations Code, is amended |
|---|
| 12 | 12 | | by adding Subsection (c-1) and amending Subsections (g) and (h) to |
|---|
| 13 | 13 | | read as follows: |
|---|
| 14 | 14 | | (c-1) The training program may include up to 40 hours of |
|---|
| 15 | 15 | | instruction through an online course from a provider approved by |
|---|
| 16 | 16 | | the commission. |
|---|
| 17 | 17 | | (g) A person's license under this section expires on August |
|---|
| 18 | 18 | | 1 following [the first birthday of the person occurring after] the |
|---|
| 19 | 19 | | second anniversary of the date the commission licenses the person. |
|---|
| 20 | 20 | | A renewed school marshal license expires on August 1 [the person's |
|---|
| 21 | 21 | | birth date], two years after the expiration of the previous |
|---|
| 22 | 22 | | license. |
|---|
| 23 | 23 | | (h) A person may renew the school marshal license under this |
|---|
| 24 | 24 | | section by: |
|---|
| 25 | 25 | | (1) successfully completing a renewal course designed |
|---|
| 26 | 26 | | and administered by the commission, which such license renewal |
|---|
| 27 | 27 | | training will not exceed 10 [16] hours combined of classroom and |
|---|
| 28 | 28 | | simulation training; |
|---|
| 29 | 29 | | (2) demonstrating appropriate knowledge on an |
|---|
| 30 | 30 | | examination designed and administered by the commission; |
|---|
| 31 | 31 | | (3) demonstrating handgun proficiency to the |
|---|
| 32 | 32 | | satisfaction of the commission staff; and |
|---|
| 33 | 33 | | (4) demonstrating psychological fitness on the |
|---|
| 34 | 34 | | examination described in Subsection (d). |
|---|
| 35 | 35 | | SECTION 2. (a) A license issued or renewed before the |
|---|
| 36 | 36 | | effective date of this Act expires on August 1 following the second |
|---|
| 37 | 37 | | anniversary of the date the Texas Commission on Law Enforcement |
|---|
| 38 | 38 | | issued or renewed the previous license. |
|---|
| 39 | 39 | | (b) The change in law made by amending Section 1701.260(h), |
|---|
| 40 | 40 | | Occupations Code, applies to a school marshal license renewal |
|---|
| 41 | 41 | | training course for a license that expires on or after the effective |
|---|
| 42 | 42 | | date of this Act. |
|---|
| 43 | 43 | | SECTION 3. This Act takes effect September 1, 2019. |
