| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Chapter 1951, Insurance Code, is amended by | |
| 11 | 11 | adding Section 1951.005 to read as follows: | |
| 12 | 12 | Sec. 1951.005. PROOF OF CITIZENSHIP REQUIRED. An agent or | |
| 13 | 13 | insurer, including a county mutual insurance company, may not | |
| 14 | 14 | deliver, issue for delivery, or renew in this state a personal | |
| 15 | 15 | automobile insurance policy unless the proposed insured provides to | |
| 16 | 16 | the agent or insurer one of the following documents as proof of | |
| 17 | 17 | United States citizenship: | |
| 18 | 18 | (1) an unexpired passport issued to the person; | |
| 19 | 19 | (2) a certified copy of a birth certificate or other | |
| 20 | 20 | document confirming the person's birth that is admissible in a | |
| 21 | 21 | court of law and establishes the person's identity; or | |
| 22 | 22 | (3) United States citizenship papers issued to the | |
| 23 | 23 | person. | |
| 24 | 24 | SECTION 2. The change in law made by this Act applies only | |
| 25 | 25 | to a personal automobile insurance policy that is delivered, issued | |
| 26 | 26 | for delivery, or renewed on or after January 1, 2020. | |
| 27 | 27 | SECTION 3. This Act takes effect September 1, 2019. |
