55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to proof of United States citizenship for the issuance or
88 renewal of a personal automobile insurance policy.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 1951, Insurance Code, is amended by
1111 adding Section 1951.005 to read as follows:
1212 Sec. 1951.005. PROOF OF CITIZENSHIP REQUIRED. An agent or
1313 insurer, including a county mutual insurance company, may not
1414 deliver, issue for delivery, or renew in this state a personal
1515 automobile insurance policy unless the proposed insured provides to
1616 the agent or insurer one of the following documents as proof of
1717 United States citizenship:
1818 (1) an unexpired passport issued to the person;
1919 (2) a certified copy of a birth certificate or other
2020 document confirming the person's birth that is admissible in a
2121 court of law and establishes the person's identity; or
2222 (3) United States citizenship papers issued to the
2323 person.
2424 SECTION 2. The change in law made by this Act applies only
2525 to a personal automobile insurance policy that is delivered, issued
2626 for delivery, or renewed on or after January 1, 2020.
2727 SECTION 3. This Act takes effect September 1, 2019.
