66 AN ACT
77 relating to the authority of certain tier 1 general-law
88 municipalities to annex certain areas on petition by the area's
99 property owners.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 43, Local Government Code,
1212 is amended by adding Section 43.0325 to read as follows:
1313 Sec. 43.0325. AUTHORITY OF CERTAIN MUNICIPALITIES TO ANNEX
1414 NONCONTIGUOUS AREA ON OWNER PETITION. (a) This section applies
1515 only to a municipality with a population of 1,780 to 1,800.
1616 (b) A municipality may annex an area that is noncontiguous
1717 to the boundaries of the municipality if:
1818 (1) the area's land development standards are more
1919 stringent than the land development standards in the municipality;
2020 and
2121 (2) the municipality receives a petition requesting
2222 the annexation that:
2323 (A) describes the area by metes and bounds;
2424 (B) is signed by each owner of real property in
2525 the area; and
2626 (C) is filed with the secretary of the
2727 municipality.
2828 SECTION 2. This Act takes effect immediately if it receives
2929 a vote of two-thirds of all the members elected to each house, as
3030 provided by Section 39, Article III, Texas Constitution. If this
3131 Act does not receive the vote necessary for immediate effect, this
3232 Act takes effect September 1, 2019.
