| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter B, Chapter 43, Local Government Code, |
|---|
| 12 | 12 | | is amended by adding Section 43.0325 to read as follows: |
|---|
| 13 | 13 | | Sec. 43.0325. AUTHORITY OF CERTAIN MUNICIPALITIES TO ANNEX |
|---|
| 14 | 14 | | NONCONTIGUOUS AREA ON OWNER PETITION. (a) This section applies |
|---|
| 15 | 15 | | only to a municipality with a population of 1,780 to 1,800. |
|---|
| 16 | 16 | | (b) A municipality may annex an area that is noncontiguous |
|---|
| 17 | 17 | | to the boundaries of the municipality if: |
|---|
| 18 | 18 | | (1) the area's land development standards are more |
|---|
| 19 | 19 | | stringent than the land development standards in the municipality; |
|---|
| 20 | 20 | | and |
|---|
| 21 | 21 | | (2) the municipality receives a petition requesting |
|---|
| 22 | 22 | | the annexation that: |
|---|
| 23 | 23 | | (A) describes the area by metes and bounds; |
|---|
| 24 | 24 | | (B) is signed by each owner of real property in |
|---|
| 25 | 25 | | the area; and |
|---|
| 26 | 26 | | (C) is filed with the secretary of the |
|---|
| 27 | 27 | | municipality. |
|---|
| 28 | 28 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 29 | 29 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 30 | 30 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 31 | 31 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 32 | 32 | | Act takes effect September 1, 2019. |
