No. 2544 A BILL TO BE ENTITLED AN ACT relating to the authority of certain tier 1 general-law municipalities to annex certain areas on petition by the area's property owners. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter B, Chapter 43, Local Government Code, is amended by adding Section 43.0325 to read as follows: Sec. 43.0325. AUTHORITY OF CERTAIN MUNICIPALITIES TO ANNEX NONCONTIGUOUS AREA ON OWNER PETITION. (a) This section applies only to a municipality with a population of 1,780 to 1,800. (b) A municipality may annex an area that is noncontiguous to the boundaries of the municipality if: (1) the area's land development standards are more stringent than the land development standards in the municipality; and (2) the municipality receives a petition requesting the annexation that: (A) describes the area by metes and bounds; (B) is signed by each owner of real property in the area; and (C) is filed with the secretary of the municipality. SECTION 2. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2019.
