10+ individuals authorized to carry a handgun on a campus.
1311 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
14- SECTION 1. Subchapter C, Chapter 37, Education Code, is

14+ (g) The identity of a school marshal appointed under this
15+ section is confidential, except as provided by Section 37.0814 of
16+ this code or Section 1701.260(j), Occupations Code, and is not
17+ subject to a request under Chapter 552, Government Code.
18+ SECTION 2. Section 37.0813(g), Education Code, is amended
19+ to read as follows:
20+ (g) The identity of a school marshal appointed under this
21+ section is confidential, except as provided by Section 37.0814 of
22+ this code or Section 1701.260(j), Occupations Code, and is not
23+ subject to a request under Chapter 552, Government Code.
24+ SECTION 3. Subchapter C, Chapter 37, Education Code, is
1525 amended by adding Section 37.0814 to read as follows:
1626 Sec. 37.0814. LAW ENFORCEMENT COMMUNICATION AND
17- COORDINATION POLICY. (a) This section applies to a school district
18- or open-enrollment charter school that:
19- (1) authorizes an individual, other than an individual
20- described by Subsection (b), to carry a handgun for security
21- purposes under written regulations or written authorization of the
22- district or school; and
23- (2) requires an individual described by Subdivision
24- (1) to complete the school safety training and instruction
25- described by Section 411.1901(c), Government Code.
26- (b) This section does not apply with respect to:
27- (1) an individual appointed as a school marshal under
28- Section 37.0811 or 37.0813; or
29- (2) an individual employed as security personnel under
30- Section 37.081 and authorized to carry a handgun in accordance with
31- that section.
32- (c) The board of trustees of a school district or the
33- governing body of an open-enrollment charter school that is subject
34- to this section shall adopt a policy regarding communication and
35- coordination with local law enforcement agencies.
36- (d) A policy adopted under this section must require the
37- school district or open-enrollment charter school to:
27+ COORDINATION POLICY. (a) This section applies to a school
28+ district, open-enrollment charter school, or private school that:
29+ (1) appoints a school marshal under Section 37.0811 or
30+ 37.0813; or
31+ (2) authorizes any other individual to carry a handgun
32+ for security purposes under written regulations or written
33+ authorization of the district or school.
34+ (b) The board of trustees of a school district or the
35+ governing body of an open-enrollment charter school or private
36+ school that is subject to this section shall adopt a policy
37+ regarding communication and coordination with local law
38+ enforcement agencies.
39+ (c) A policy adopted under this section must require the
40+ school district, open-enrollment charter school, or private school
41+ to:
3842 (1) provide each law enforcement agency that has
3943 jurisdiction over the district or school with:
4044 (A) a list of each campus at which an individual
4145 described by Subsection (a) is authorized to carry a handgun; and
4246 (B) the identity of each individual described by
4347 Subsection (a) and the campus where that individual is regularly
4448 employed; and
4549 (2) update, as necessary, the information provided
4650 under Subdivision (1).
47- (e) Information provided to a law enforcement agency under a

4852 policy adopted under this section regarding the identity or place
4953 of employment of an individual described by Subsection (a) is
5054 confidential, may be used by the law enforcement agency only for law
5155 enforcement purposes, and is not subject to a request under Chapter
5256 552, Government Code.
53- SECTION 2. This Act takes effect September 1, 2019.
57+ SECTION 4. Section 51.220(h), Education Code, is amended to
58+ read as follows:
59+ (h) The identity of a school marshal appointed under this
60+ section is confidential, except as provided by Section 51.221 of
61+ this code or Section 1701.260(j), Occupations Code, and is not
62+ subject to a request under Chapter 552, Government Code.
63+ SECTION 5. Subchapter E, Chapter 51, Education Code, is
64+ amended by adding Section 51.221 to read as follows:
65+ Sec. 51.221. LAW ENFORCEMENT COMMUNICATION AND
66+ COORDINATION POLICY. (a) This section applies to a public junior
67+ college, as defined by Section 61.003, that appoints a school
68+ marshal under Section 51.220.
69+ (b) The governing board of a public junior college that is
70+ subject to this section shall adopt a policy regarding
71+ communication and coordination with local law enforcement
72+ agencies.
73+ (c) A policy adopted under this section must require the
74+ public junior college to:
75+ (1) provide each law enforcement agency that has
76+ jurisdiction over the public junior college with:
77+ (A) a list of each campus at which a school
78+ marshal is authorized to carry a handgun; and
79+ (B) the identity of each school marshal and the
80+ campus where that individual is regularly employed; and
81+ (2) update, as necessary, the information provided
82+ under Subdivision (1).
83+ (d) Information provided to a law enforcement agency under a
84+ policy adopted under this section regarding the identity or place
85+ of employment of a school marshal is confidential, may be used by
86+ the law enforcement agency only for law enforcement purposes, and
87+ is not subject to a request under Chapter 552, Government Code.
88+ SECTION 6. This Act takes effect September 1, 2019.
