4	12		AN ACT
5	13		relating to the manner of reporting and maintaining certain
6	14		information relating to candidates and election returns.
7	15		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	16		SECTION 1. Sections 67.007(a), (c), and (d), Election Code,
9	17		are amended to read as follows:
10	18		(a) For each election for a statewide, [or] district,
11	19		county, or precinct office, a statewide measure, or president and
12	20		vice-president of the United States, the county clerk of each
13	21		county in the territory covered by the election shall prepare
14	22		county election returns.
15	23		(c) The county clerk shall certify [sign] the county returns
16	24		[to certify their accuracy].
17	25		(d) Not later than 24 hours after completion of the local
18	26		canvass, the county clerk shall deliver to the secretary of state,
19	27		in the manner directed by the secretary, the county returns [in a
20	28		sealed envelope]. [The envelope shall be labeled: "Election
21	29		Returns for __________ (name) County, for __________(election)."]
22	30		SECTION 2. Sections 67.008(b) and (c), Election Code, are
23	31		amended to read as follows:
24	32		(b) The returns shall be delivered to the secretary of state
25	33		as provided by Section 67.007. [, except that the envelope shall be
26	34		labeled: "Returns of Election for Governor/Lieutenant Governor,
27	35		__________ (name) County, for __________(election)."]
28	36		(c) The secretary of state shall retain the returns [in
29	37		their sealed condition] until the first day of the next regular
30	38		legislative session, when the secretary shall deliver the returns
31	39		to the speaker of the house of representatives.
32	40		SECTION 3. Section 67.009(b), Election Code, is amended to
33	41		read as follows:
34	42		(b) With the delivery of the official county returns forms,
35	43		the secretary of state shall deliver[:
36	44		[(1)] written instructions on the preparation and
37	45		delivery of the county election returns[; and
38	46		[(2) the officially prescribed envelopes for
39	47		delivering the returns to the secretary].
40	48		SECTION 4. Section 181.032, Election Code, is amended by
41	49		amending Subsection (b) and adding Subsection (c) to read as
42	50		follows:
43	51		(b) Not later than the 10th day after the date of the filing
44	52		deadline prescribed by Section 181.033, the authority with whom an
45	53		application is filed shall deliver to the secretary of state a list
46	54		containing:
47	55		(1) each candidate's name;
48	56		(2) each candidate's residence address;
49	57		(3) the office sought by the candidate; [and]
50	58		(4) the date on which the candidate filed the
51	59		application; and
52	60		(5) any additional information required by the
53	61		secretary of state.
54	62		(c) A list delivered under Subsection (b) must be in a
55	63		format prescribed by the secretary of state.
56	64		SECTION 5. Section 181.068(a), Election Code, is amended to
57	65		read as follows:
58	66		(a) The presiding officer of each convention held under this
59	67		chapter shall certify, in a format prescribed by the secretary of
60	68		state, [writing] for placement on the general election ballot the
61	69		name and address of each candidate nominated by the convention.
62	70		SECTION 6. This Act takes effect September 1, 2019.
