412 AN ACT
513 relating to the authority of the Texas Commission on Environmental
614 Quality to issue permits for the discharge into water in this state
715 of produced water, hydrostatic test water, and gas plant effluent
816 resulting from certain oil and gas activities.
917 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1018 SECTION 1. Section 26.131, Water Code, as effective until
1119 delegation of authority under the Resource Conservation and
1220 Recovery Act of 1976 (42 U.S.C. Section 6901 et seq.) to the
1321 Railroad Commission of Texas, is amended by amending Subsections
1422 (a) and (b) and adding Subsection (d) to read as follows:
1523 (a) Except as provided by this section, the [The] Railroad
1624 Commission of Texas is solely responsible for the control and
1725 disposition of waste and the abatement and prevention of pollution
1826 of surface and subsurface water resulting from:
1927 (1) activities associated with the exploration,
2028 development, and production of oil or gas or geothermal resources,
2129 including:
2230 (A) activities associated with the drilling of
2331 injection water source wells which penetrate the base of useable
2432 quality water;
2533 (B) activities associated with the drilling of
2634 cathodic protection holes associated with the cathodic protection
2735 of wells and pipelines subject to the jurisdiction of the Railroad
2836 Commission of Texas;
2937 (C) activities associated with gasoline plants,
3038 natural gas or natural gas liquids processing plants, pressure
3139 maintenance plants, or repressurizing plants;
3240 (D) activities associated with any underground
3341 natural gas storage facility, provided the terms "natural gas" and
3442 "storage facility" shall have the meanings set out in Section
3543 91.173, Natural Resources Code;
3644 (E) activities associated with any underground
3745 hydrocarbon storage facility, provided the terms "hydrocarbons"
3846 and "underground hydrocarbon storage facility" shall have the
3947 meanings set out in Section 91.201, Natural Resources Code; and
4048 (F) activities associated with the storage,
4149 handling, reclamation, gathering, transportation, or distribution
4250 of oil or gas prior to the refining of such oil or prior to the use
4351 of such gas in any manufacturing process or as a residential or
4452 industrial fuel;
4553 (2) except to the extent the activities are regulated
4654 by the Texas Department of Health under Chapter 401, Health and
4755 Safety Code, activities associated with uranium exploration
4856 consisting of the disturbance of the surface or subsurface for the
4957 purpose of or related to determining the location, quantity, or
5058 quality of uranium ore; and
5159 (3) any other activities regulated by the Railroad
5260 Commission of Texas pursuant to Section 91.101, Natural Resources
5361 Code.
5462 (b) Except as provided by Subsection (d), the [The] Railroad
5563 Commission of Texas may issue permits for the discharge of waste
5664 resulting from the [these] activities described by Subsection (a),
5765 and the discharge of waste into water in this state resulting from
5866 those [these] activities must [shall] meet the water quality
5967 standards established by the commission.
6068 (d) The commission may issue permits for the discharge into
6169 water in this state of produced water, hydrostatic test water, and
6270 gas plant effluent resulting from the activities described by
6371 Subsection (a) on delegation to the commission of NPDES authority
6472 for those discharges. The discharge of produced water, hydrostatic
6573 test water, and gas plant effluent into water in this state under
6674 this subsection must meet the water quality standards established
6775 by the commission.
6876 SECTION 2. Section 26.131, Water Code, as effective on
6977 delegation of authority under the Resource Conservation and
7078 Recovery Act of 1976 (42 U.S.C. 6901 et seq.) to the Railroad
7179 Commission of Texas, is amended to read as follows:
7280 Sec. 26.131. DUTIES OF RAILROAD COMMISSION. (a) Except as
7381 provided by this section, the [The] Railroad Commission of Texas is
7482 solely responsible for the control and disposition of waste and the
7583 abatement and prevention of pollution of surface and subsurface
7684 water resulting from:
7785 (1) activities associated with the exploration,
7886 development, and production of oil or gas or geothermal resources,
7987 including:
8088 (A) activities associated with the drilling of
8189 injection water source wells which penetrate the base of useable
8290 quality water;
8391 (B) activities associated with the drilling of
8492 cathodic protection holes associated with the cathodic protection
8593 of wells and pipelines subject to the jurisdiction of the Railroad
8694 Commission of Texas;
8795 (C) activities associated with gasoline plants,
8896 natural gas or natural gas liquids processing plants, pressure
8997 maintenance plants, or repressurizing plants;
9098 (D) activities associated with any underground
9199 natural gas storage facility, provided the terms "natural gas" and
92100 "storage facility" shall have the meanings set out in Section
93101 91.173, Natural Resources Code;
94102 (E) activities associated with any underground
95103 hydrocarbon storage facility, provided the terms "hydrocarbons"
96104 and "underground hydrocarbon storage facility" shall have the
97105 meanings set out in Section 91.201, Natural Resources Code; and
98106 (F) activities associated with the storage,
99107 handling, reclamation, gathering, transportation, or distribution
100108 of oil or gas prior to the refining of such oil or prior to the use
101109 of such gas in any manufacturing process or as a residential or
102110 industrial fuel;
103111 (2) except to the extent the activities are regulated
104112 by the Texas Department of Health under Chapter 401, Health and
105113 Safety Code, activities associated with uranium exploration
106114 consisting of the disturbance of the surface or subsurface for the
107115 purpose of or related to determining the location, quantity, or
108116 quality of uranium ore; and
109117 (3) any other activities regulated by the Railroad
110118 Commission of Texas pursuant to Section 91.101, Natural Resources
111119 Code.
112120 (b) Except as provided by Subsection (c), the [The] Railroad
113121 Commission of Texas may issue permits for the discharge of waste
114122 resulting from the [these] activities described by Subsection (a),
115123 and the discharge of waste into water in this state resulting from
116124 those [these] activities must [shall] meet the water quality
117125 standards established by the commission.
118126 (c) The commission may issue permits for the discharge into
119127 water in this state of produced water, hydrostatic test water, and
120128 gas plant effluent resulting from the activities described by
121129 Subsection (a) on delegation to the commission of NPDES authority
122130 for those discharges. The discharge of produced water, hydrostatic
123131 test water, and gas plant effluent into water in this state under
124132 this subsection must meet the water quality standards established
125133 by the commission.
126134 SECTION 3. (a) In this section:
127135 (1) "Commission" means the Texas Commission on
128136 Environmental Quality.
129137 (2) "NPDES" means National Pollutant Discharge
130138 Elimination System.
131139 (b) On delegation of NPDES permit authority for discharges
132140 of produced water, hydrostatic test water, and gas plant effluent
133141 to the commission by the United States Environmental Protection
134142 Agency under Section 402(b) of the Federal Water Pollution Control
135143 Act (33 U.S.C. Section 1342(b)), the following are transferred from
136144 the Railroad Commission of Texas to the commission:
137145 (1) the powers, duties, functions, programs, and
138146 activities of the Railroad Commission of Texas relating to the
139147 regulation of discharges of produced water, hydrostatic test water,
140148 and gas plant effluent into water in this state, other than
141149 discharges resulting from spills or other unplanned releases;
142150 (2) any obligations and contracts of the Railroad
143151 Commission of Texas that are directly related to implementing a
144152 power, duty, function, program, or activity transferred under this
145153 Act; and
146154 (3) all property and records in the custody of the
147155 Railroad Commission of Texas that are related to a power, duty,
148156 function, program, or activity transferred under this Act.
149157 (c) The Railroad Commission of Texas shall continue to carry
150158 out its duties related to the regulation of discharges of produced
151159 water, hydrostatic test water, and gas plant effluent into water in
152160 this state until delegation of NPDES permit authority for
153161 discharges of produced water, hydrostatic test water, and gas plant
154162 effluent to the commission by the United States Environmental
155163 Protection Agency under Section 402(b) of the Federal Water
156164 Pollution Control Act (33 U.S.C. Section 1342(b)).
157165 (d) The commission may carry out activities to ensure an
158166 orderly transfer of the powers, duties, functions, programs, and
159167 activities transferred under this Act, including hiring additional
160168 employees and amending the memorandum of understanding by mutual
161169 agreement with the Railroad Commission of Texas.
162- (e) Not later than September 1, 2021, the commission shall

163171 submit to the United States Environmental Protection Agency for
164172 approval a request to supplement or amend the Texas Pollutant
165173 Discharge Elimination System program to include delegation of NPDES
166174 permit authority for discharges of produced water, hydrostatic test
167175 water, and gas plant effluent.
168176 SECTION 4. The change in law made by this Act to Section
169177 26.131, Water Code, applies to an application for an authorization
170178 to discharge produced water, hydrostatic test water, or gas plant
171179 effluent into water in this state that is pending on or after the
172180 effective date of delegation of National Pollutant Discharge
173181 Elimination System permit authority for discharges of produced
174182 water, hydrostatic test water, and gas plant effluent to the Texas
175183 Commission on Environmental Quality by the United States
176184 Environmental Protection Agency under Section 402(b) of the Federal
177185 Water Pollution Control Act (33 U.S.C. Section 1342(b)). An
178186 application that is granted or denied in a final decision before the
179187 effective date of such delegation is governed by the law as it
180188 existed immediately before the effective date of such delegation,
181189 and that law is continued in effect for that purpose.
182190 SECTION 5. This Act takes effect September 1, 2019.
