68 AN ACT
79 relating to disclosure requirements of certain facilities that
810 provide care for persons with Alzheimer's disease and related
911 disorders.
1012 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1113 SECTION 1. Subchapter B, Chapter 242, Health and Safety
1214 Code, is amended by adding Section 242.0405 to read as follows:
1315 Sec. 242.0405. NOTICE OF ALZHEIMER'S DISEASE AND RELATED
1416 DISORDERS CERTIFICATION. (a) A nursing facility shall prepare a
1517 written notice disclosing whether the facility is certified or is
1618 not certified under Section 242.040 for the provision of
1719 specialized care and treatment of residents with Alzheimer's
1820 disease and related disorders.
1921 (b) The nursing facility shall provide the notice described
2022 by Subsection (a) to:
2123 (1) each resident of the facility; and
2224 (2) each person applying for services from the
2325 facility or the person's next of kin or guardian.
2426 SECTION 2. Section 242.202(d), Health and Safety Code, is
2527 amended to read as follows:
2628 (d) The disclosure statement must contain the following
2729 categories of information:
2830 (1) the institution's philosophy of care;
2931 (2) [whether the institution is certified under
3032 Section 242.040 for the provision of specialized care and treatment
3133 of residents with Alzheimer's disease and related disorders;
3234 [(3)] the preadmission, admission, and discharge
3335 process;
3436 (3) [(4)] resident assessment, care planning, and
3537 implementation of the care plan;
3638 (4) [(5)] staffing patterns, such as
3739 resident-to-staff ratios, and staff training;
3840 (5) [(6)] the physical environment of the
3941 institution;
4042 (6) [(7)] resident activities;
4143 (7) [(8)] program costs;
4244 (8) [(9)] systems for evaluation of the institution's
4345 programs for residents;
4446 (9) [(10)] family involvement in resident care; and
4547 (10) [(11)] the toll-free telephone number maintained
4648 by the department for acceptance of complaints against the
4749 institution.
4850 SECTION 3. Subchapter B, Chapter 247, Health and Safety
4951 Code, is amended by adding Section 247.0295 to read as follows:
5052 Sec. 247.0295. NOTICE OF ALZHEIMER'S DISEASE OR RELATED
5153 DISORDERS LICENSE CLASSIFICATION. An assisted living facility
5254 shall provide to each resident of the facility written notice
5355 disclosing whether the facility holds a license or does not hold a
5456 license classified under Section 247.029 for the provision of
5557 personal care services to residents with Alzheimer's disease or
5658 related disorders.
5759 SECTION 4. Section 247.026(c-1), Health and Safety Code, is
5860 repealed.
5961 SECTION 5. As soon as practicable after the effective date
6062 of this Act, the executive commissioner of the Health and Human
6163 Services Commission shall adopt rules to implement the changes in
6264 law made by this Act.
6365 SECTION 6. This Act takes effect September 1, 2019.
