6	8		AN ACT
7	9		relating to disclosure requirements of certain facilities that
8	10		provide care for persons with Alzheimer's disease and related
9	11		disorders.
10	12		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	13		SECTION 1. Subchapter B, Chapter 242, Health and Safety
12	14		Code, is amended by adding Section 242.0405 to read as follows:
13	15		Sec. 242.0405. NOTICE OF ALZHEIMER'S DISEASE AND RELATED
14	16		DISORDERS CERTIFICATION. (a) A nursing facility shall prepare a
15	17		written notice disclosing whether the facility is certified or is
16	18		not certified under Section 242.040 for the provision of
17	19		specialized care and treatment of residents with Alzheimer's
18	20		disease and related disorders.
19	21		(b) The nursing facility shall provide the notice described
20	22		by Subsection (a) to:
21	23		(1) each resident of the facility; and
22	24		(2) each person applying for services from the
23	25		facility or the person's next of kin or guardian.
24	26		SECTION 2. Section 242.202(d), Health and Safety Code, is
25	27		amended to read as follows:
26	28		(d) The disclosure statement must contain the following
27	29		categories of information:
28	30		(1) the institution's philosophy of care;
29	31		(2) [whether the institution is certified under
30	32		Section 242.040 for the provision of specialized care and treatment
31	33		of residents with Alzheimer's disease and related disorders;
32	34		[(3)] the preadmission, admission, and discharge
33	35		process;
34	36		(3) [(4)] resident assessment, care planning, and
35	37		implementation of the care plan;
36	38		(4) [(5)] staffing patterns, such as
37	39		resident-to-staff ratios, and staff training;
38	40		(5) [(6)] the physical environment of the
39	41		institution;
40	42		(6) [(7)] resident activities;
41	43		(7) [(8)] program costs;
42	44		(8) [(9)] systems for evaluation of the institution's
43	45		programs for residents;
44	46		(9) [(10)] family involvement in resident care; and
45	47		(10) [(11)] the toll-free telephone number maintained
46	48		by the department for acceptance of complaints against the
47	49		institution.
48	50		SECTION 3. Subchapter B, Chapter 247, Health and Safety
49	51		Code, is amended by adding Section 247.0295 to read as follows:
50	52		Sec. 247.0295. NOTICE OF ALZHEIMER'S DISEASE OR RELATED
51	53		DISORDERS LICENSE CLASSIFICATION. An assisted living facility
52	54		shall provide to each resident of the facility written notice
53	55		disclosing whether the facility holds a license or does not hold a
54	56		license classified under Section 247.029 for the provision of
55	57		personal care services to residents with Alzheimer's disease or
56	58		related disorders.
57	59		SECTION 4. Section 247.026(c-1), Health and Safety Code, is
58	60		repealed.
59	61		SECTION 5. As soon as practicable after the effective date
60	62		of this Act, the executive commissioner of the Health and Human
61	63		Services Commission shall adopt rules to implement the changes in
62	64		law made by this Act.
63	65		SECTION 6. This Act takes effect September 1, 2019.
