17 | 14 | | under Chapter 560 has ceased to operate for a period of 30 days or |

18 | 15 | | longer, the board shall notify the pharmacy that the license will be |

19 | 16 | | revoked. |

20 | 17 | | (b) The notice must: |
---|
21 | 18 | | (1) include a statement that the pharmacy license is |
---|
22 | 19 | | being revoked for violation of Section 565.002(a)(7); and |
---|
23 | 20 | | (2) inform the license holder of the license holder's |
---|
24 | 21 | | right to a hearing to contest the revocation. |
---|
25 | 22 | | (c) Not later than the 20th day after the date the license |
---|
26 | 23 | | holder receives the notice of revocation under this section, the |
---|
27 | 24 | | license holder may submit a written request for a hearing to contest |
---|
28 | 25 | | the revocation. |
---|
29 | 26 | | (d) If the license holder does not request a hearing within |
---|
30 | 27 | | the period prescribed by Subsection (c), the board shall: |
---|
31 | 28 | | (1) enter an order revoking the license; and |
---|
32 | 29 | | (2) notify the license holder of the order. |
---|
33 | 30 | | (e) If the license holder requests a hearing within the |
---|
34 | 31 | | period prescribed by Subsection (c), a panel of three board members |
---|
35 | 32 | | appointed by the president of the board shall conduct the hearing. |
---|
36 | 33 | | At the hearing the panel shall determine whether the license holder |
---|
37 | 34 | | has violated Section 565.002(a)(7). |
---|
38 | 35 | | (f) If the panel determines that the license holder |
---|
39 | 36 | | committed the violation, the board shall promptly: |
---|
40 | 37 | | (1) enter an order revoking the license; and |
---|
41 | 38 | | (2) notify the license holder of the order. |
