| 7 | 7 | | relating to authorizing parents of students enrolled at a |
|---|
| 8 | 8 | | low-performing public school campus to petition the commissioner of |
|---|
| 9 | 9 | | education for the appointment of a board of managers, alternative |
|---|
| 10 | 10 | | management, or closure of the campus. |
|---|
| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 39A.112, Education Code, is amended by |
|---|
| 13 | 13 | | amending Subsection (b) and adding Subsections (b-1) and (b-2) to |
|---|
| 14 | 14 | | read as follows: |
|---|
| 15 | 15 | | (b) Notwithstanding Section 39A.101, if a campus has been |
|---|
| 16 | 16 | | assigned an unacceptable performance rating under Section 39.054 |
|---|
| 17 | 17 | | for two consecutive school years, a majority of the parents of the |
|---|
| 18 | 18 | | students enrolled at the campus may, at any time, submit a petition |
|---|
| 19 | 19 | | to the commissioner requesting that the commissioner order one of |
|---|
| 20 | 20 | | the following actions: |
|---|
| 21 | 21 | | (1) appointment of a board of managers to govern the |
|---|
| 22 | 22 | | school district as provided by Section 39A.202; |
|---|
| 23 | 23 | | (2) alternative management of the campus; or |
|---|
| 24 | 24 | | (3) closure of the campus [If the commissioner is |
|---|
| 25 | 25 | | presented, in the time and manner specified by commissioner rule, |
|---|
| 26 | 26 | | with a written petition signed by the parents of a majority of the |
|---|
| 27 | 27 | | students enrolled at a campus to which Section 39A.111 applies, |
|---|
| 28 | 28 | | specifying an action authorized under that section that the parents |
|---|
| 29 | 29 | | request the commissioner to order, the commissioner shall, except |
|---|
| 30 | 30 | | as otherwise authorized by this section, order the specific action |
|---|
| 31 | 31 | | requested]. |
|---|
| 32 | 32 | | (b-1) The commissioner shall consider the action requested |
|---|
| 33 | 33 | | in a parents' petition under Subsection (b) in determining whether |
|---|
| 34 | 34 | | to order the requested action or another permissible action under |
|---|
| 35 | 35 | | this subchapter, including ordering the campus to prepare or |
|---|
| 36 | 36 | | implement a campus turnaround plan. |
|---|
| 37 | 37 | | (b-2) A petition submitted under Subsection (b) must be in a |
|---|
| 38 | 38 | | form prescribed by the commissioner. |
|---|
| 39 | 39 | | SECTION 2. This Act applies beginning with the 2019-2020 |
|---|
| 40 | 40 | | school year. |
|---|
| 41 | 41 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 42 | 42 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 43 | 43 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 44 | 44 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 45 | 45 | | Act takes effect September 1, 2019. |
