55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to certain retirees of the Teacher Retirement System of
88 Texas who resume certain employment with a school district.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 21.402, Education Code, is amended by
1111 amending Subsections (a) and (c-1) and adding Subsection (f-1) to
1212 read as follows:
1313 (a) Except as provided by Subsection (e-1), [or] (f), or
1414 (f-1), a school district must pay each classroom teacher, full-time
1515 librarian, full-time school counselor certified under Subchapter
1616 B, or full-time school nurse not less than the minimum monthly
1717 salary, based on the employee's level of experience in addition to
1818 other factors, as determined by commissioner rule, determined by
1919 the following formula:
2020 MS = SF x FS
2121 where:
2222 "MS" is the minimum monthly salary;
2323 "SF" is the applicable salary factor specified by Subsection
2424 (c); and
2525 "FS" is the amount, as determined by the commissioner under
2626 Subsection (b), of the basic allotment as provided by Section
2727 42.101(a) or (b) for a school district with a maintenance and
2828 operations tax rate at least equal to the state maximum compressed
2929 tax rate, as defined by Section 42.101(a).
3030 (c-1) Notwithstanding Subsections (a) and (b) and except as
3131 provided by Subsection (f-1), each school district shall pay a
3232 monthly salary to each classroom teacher, full-time speech
3333 pathologist, full-time librarian, full-time school counselor
3434 certified under Subchapter B, and full-time school nurse that is at
3535 least equal to the following monthly salary or the monthly salary
3636 determined by the commissioner under Subsections (a) and (b),
3737 whichever is greater:

8484 (f-1) This section does not apply to a person who is a
8585 retiree of the Teacher Retirement System of Texas described by
8686 Section 825.4092(e)(2), Government Code.
8787 SECTION 2. Section 825.4092, Government Code, is amended by
8888 amending Subsection (e) and adding Subsection (f) to read as
8989 follows:
9090 (e) The amounts required to be paid under Subsections (b)
9191 and (c) are not required to be paid by a reporting employer for a
9292 retiree who retired from the retirement system:
9393 (1) before September 1, 2005; or
9494 (2) on or after September 1, 2005, if the retiree is:
9595 (A) a teacher certified under Subchapter B,
9696 Chapter 21, Education Code, and teaching on as much as a full-time
9797 basis in an acute shortage area, as determined under rules adopted
9898 by the commissioner of education; or
9999 (B) a bus driver certified in accordance with
100100 standards and qualifications adopted by the Department of Public
101101 Safety of the State of Texas and employed on as much as a full-time
102102 basis by a school district.
103103 (f) For purposes of Subsection (e)(2)(A), an "acute
104104 shortage area" may include:
105105 (1) a school district in a region of this state in
106106 which there is a shortage of teachers; or
107107 (2) a subject area in which there is a shortage of
108108 teachers certified to teach the subject area in the school
109109 districts of this state or in school districts in a region of this
110110 state.
111111 SECTION 3. The changes in law made by this Act apply to a
112112 retiree of the Teacher Retirement System of Texas regardless of
113113 whether the person retired from employment before, on, or after the
114114 effective date of this Act.
115115 SECTION 4. The changes in law made by this Act apply
116116 beginning with the 2019-2020 school year.
117117 SECTION 5. This Act takes effect immediately if it receives
118118 a vote of two-thirds of all the members elected to each house, as
119119 provided by Section 39, Article III, Texas Constitution. If this
120120 Act does not receive the vote necessary for immediate effect, this
121121 Act takes effect September 1, 2019.
