6	6	AN ACT
7	7	relating to certain retirees of the Teacher Retirement System of
8	8	Texas who resume certain employment with a school district.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 21.402, Education Code, is amended by
11	11	amending Subsections (a) and (c-1) and adding Subsection (f-1) to
12	12	read as follows:
13	13	(a) Except as provided by Subsection (e-1), [or] (f), or
14	14	(f-1), a school district must pay each classroom teacher, full-time
15	15	librarian, full-time school counselor certified under Subchapter
16	16	B, or full-time school nurse not less than the minimum monthly
17	17	salary, based on the employee's level of experience in addition to
18	18	other factors, as determined by commissioner rule, determined by
19	19	the following formula:
20	20	MS = SF x FS
21	21	where:
22	22	"MS" is the minimum monthly salary;
23	23	"SF" is the applicable salary factor specified by Subsection
24	24	(c); and
25	25	"FS" is the amount, as determined by the commissioner under
26	26	Subsection (b), of the basic allotment as provided by Section
27	27	42.101(a) or (b) for a school district with a maintenance and
28	28	operations tax rate at least equal to the state maximum compressed
29	29	tax rate, as defined by Section 42.101(a).
30	30	(c-1) Notwithstanding Subsections (a) and (b) and except as
31	31	provided by Subsection (f-1), each school district shall pay a
32	32	monthly salary to each classroom teacher, full-time speech
33	33	pathologist, full-time librarian, full-time school counselor
34	34	certified under Subchapter B, and full-time school nurse that is at
35	35	least equal to the following monthly salary or the monthly salary
36	36	determined by the commissioner under Subsections (a) and (b),
37	37	whichever is greater:

84	84	(f-1) This section does not apply to a person who is a
85	85	retiree of the Teacher Retirement System of Texas described by
86	86	Section 825.4092(e)(2), Government Code.
87	87	SECTION 2. Section 825.4092, Government Code, is amended by
88	88	amending Subsection (e) and adding Subsection (f) to read as
89	89	follows:
90	90	(e) The amounts required to be paid under Subsections (b)
91	91	and (c) are not required to be paid by a reporting employer for a
92	92	retiree who retired from the retirement system:
93	93	(1) before September 1, 2005; or
94	94	(2) on or after September 1, 2005, if the retiree is:
95	95	(A) a teacher certified under Subchapter B,
96	96	Chapter 21, Education Code, and teaching on as much as a full-time
97	97	basis in an acute shortage area, as determined under rules adopted
98	98	by the commissioner of education; or
99	99	(B) a bus driver certified in accordance with
100	100	standards and qualifications adopted by the Department of Public
101	101	Safety of the State of Texas and employed on as much as a full-time
102	102	basis by a school district.
103	103	(f) For purposes of Subsection (e)(2)(A), an "acute
104	104	shortage area" may include:
105	105	(1) a school district in a region of this state in
106	106	which there is a shortage of teachers; or
107	107	(2) a subject area in which there is a shortage of
108	108	teachers certified to teach the subject area in the school
109	109	districts of this state or in school districts in a region of this
110	110	state.
111	111	SECTION 3. The changes in law made by this Act apply to a
112	112	retiree of the Teacher Retirement System of Texas regardless of
113	113	whether the person retired from employment before, on, or after the
114	114	effective date of this Act.
115	115	SECTION 4. The changes in law made by this Act apply
116	116	beginning with the 2019-2020 school year.
117	117	SECTION 5. This Act takes effect immediately if it receives
118	118	a vote of two-thirds of all the members elected to each house, as
119	119	provided by Section 39, Article III, Texas Constitution. If this
120	120	Act does not receive the vote necessary for immediate effect, this
121	121	Act takes effect September 1, 2019.
