 A BILL TO BE ENTITLED
 AN ACT
 relating to certain retirees of the Teacher Retirement System of
 Texas who resume certain employment with a school district.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Section 21.402, Education Code, is amended by
 amending Subsections (a) and (c-1) and adding Subsection (f-1) to
 read as follows:
 (a)  Except as provided by Subsection (e-1), [or] (f), or
 (f-1), a school district must pay each classroom teacher, full-time
 librarian, full-time school counselor certified under Subchapter
 B, or full-time school nurse not less than the minimum monthly
 salary, based on the employee's level of experience in addition to
 other factors, as determined by commissioner rule, determined by
 the following formula:
 MS = SF x FS
 where:
 "MS" is the minimum monthly salary;
 "SF" is the applicable salary factor specified by Subsection
 (c); and
 "FS" is the amount, as determined by the commissioner under
 Subsection (b), of the basic allotment as provided by Section
 42.101(a) or (b) for a school district with a maintenance and
 operations tax rate at least equal to the state maximum compressed
 tax rate, as defined by Section 42.101(a).
 (c-1)  Notwithstanding Subsections (a) and (b) and except as
 provided by Subsection (f-1), each school district shall pay a
 monthly salary to each classroom teacher, full-time speech
 pathologist, full-time librarian, full-time school counselor
 certified under Subchapter B, and full-time school nurse that is at
 least equal to the following monthly salary or the monthly salary
 determined by the commissioner under Subsections (a) and (b),
 whichever is greater:

 (f-1)  This section does not apply to a person who is a
 retiree of the Teacher Retirement System of Texas described by
 Section 825.4092(e)(2), Government Code.
 SECTION 2.  Section 825.4092, Government Code, is amended by
 amending Subsection (e) and adding Subsection (f) to read as
 follows:
 (e)  The amounts required to be paid under Subsections (b)
 and (c) are not required to be paid by a reporting employer for a
 retiree who retired from the retirement system:
 (1)   before September 1, 2005; or
 (2)  on or after September 1, 2005, if the retiree is:
 (A)  a teacher certified under Subchapter B,
 Chapter 21, Education Code, and teaching on as much as a full-time
 basis in an acute shortage area, as determined under rules adopted
 by the commissioner of education; or
 (B)  a bus driver certified in accordance with
 standards and qualifications adopted by the Department of Public
 Safety of the State of Texas and employed on as much as a full-time
 basis by a school district.
 (f)  For purposes of Subsection (e)(2)(A), an "acute
 shortage area" may include:
 (1)  a school district in a region of this state in
 which there is a shortage of teachers; or
 (2)  a subject area in which there is a shortage of
 teachers certified to teach the subject area in the school
 districts of this state or in school districts in a region of this
 state.
 SECTION 3.  The changes in law made by this Act apply to a
 retiree of the Teacher Retirement System of Texas regardless of
 whether the person retired from employment before, on, or after the
 effective date of this Act.
 SECTION 4.  The changes in law made by this Act apply
 beginning with the 2019-2020 school year.
 SECTION 5.  This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution.  If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2019.
