4	10		AN ACT
5	11		relating to the confidentiality of and prohibiting disclosure of
6	12		the location or physical layout of a family violence shelter center
7	13		or victims of trafficking shelter center; creating a criminal
8	14		offense.
9	15		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	16		SECTION 1. Section 552.138, Government Code, is amended by
11	17		amending Subsections (b) and (c) and adding Subsection (b-1) to
12	18		read as follows:
13	19		(b) Information maintained by a family violence shelter
14	20		center, victims of trafficking shelter center, or sexual assault
15	21		program is excepted from the requirements of Section 552.021 if it
16	22		is information that relates to:
17	23		(1) the home address, home telephone number, or social
18	24		security number of an employee or a volunteer worker of a family
19	25		violence shelter center, victims of trafficking shelter center, or
20	26		sexual assault program, regardless of whether the employee or
21	27		worker complies with Section 552.024;
22	28		(2) [the location or physical layout of a family
23	29		violence shelter center or victims of trafficking shelter center;
24	30		[(3)] the name, home address, home telephone number,
25	31		or numeric identifier of a current or former client of a family
26	32		violence shelter center, victims of trafficking shelter center, or
27	33		sexual assault program;
28	34		(3) [(4)] the provision of services, including
29	35		counseling and sheltering, to a current or former client of a family
30	36		violence shelter center, victims of trafficking shelter center, or
31	37		sexual assault program;
32	38		(4) [(5)] the name, home address, or home telephone
33	39		number of a private donor to a family violence shelter center,
34	40		victims of trafficking shelter center, or sexual assault program;
35	41		or
36	42		(5) [(6)] the home address or home telephone number of
37	43		a member of the board of directors or the board of trustees of a
38	44		family violence shelter center, victims of trafficking shelter
39	45		center, or sexual assault program, regardless of whether the board
40	46		member complies with Section 552.024.
41	47		(b-1) Information that relates to the location or physical
42	48		layout of a family violence shelter center or victims of
43	49		trafficking shelter center is confidential.
44	50		(c) A governmental body may redact information maintained
45	51		by a family violence shelter center, victims of trafficking shelter
46	52		center, or sexual assault program that may be withheld under
47	53		Subsection (b)(1) or (5) or that is confidential under Subsection
48	54		(b-1) [(6)] from any information the governmental body discloses
49	55		under Section 552.021 without the necessity of requesting a
50	56		decision from the attorney general under Subchapter G.
51	57		SECTION 2. Chapter 42, Penal Code, is amended by adding
52	58		Section 42.075 to read as follows:
53	59		Sec. 42.075. DISCLOSURE OF CONFIDENTIAL INFORMATION
54	60		REGARDING FAMILY VIOLENCE OR VICTIMS OF TRAFFICKING SHELTER CENTER.
55	61		(a) In this section, "family violence shelter center" and "victims
56	62		of trafficking shelter center" have the meanings assigned by
57	63		Section 552.138, Government Code.
58	64		(b) A person commits an offense if the person, with the
59	65		intent to threaten the safety of any inhabitant of a family violence
60	66		shelter center or victims of trafficking shelter center, discloses
61	67		or publicizes the location or physical layout of the center.
62	68		(c) An offense under this section is a Class A misdemeanor.
63	69		(d) If conduct constituting an offense under this section
64	70		also constitutes an offense under Section 552.352, Government Code,
65	71		the actor may be prosecuted under either section.
66	72		SECTION 3. The change in law made by this Act applies only
67	73		to a request for public information received on or after the
68	74		effective date of this Act. A request received before the effective
69	75		date of this Act is governed by the law in effect on the date the
70	76		request was received, and the former law is continued in effect for
71	77		that purpose.
72	78		SECTION 4. This Act takes effect September 1, 2019.
