4	10		AN ACT
5	11		relating to excluding certain students from the computation of
6	12		dropout and completion rates for purposes of public school
7	13		accountability.
8	14		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	15		SECTION 1. Section 39.053(g-1), Education Code, is amended
10	16		to read as follows:
11	17		(g-1) In computing dropout and completion rates such as high
12	18		school graduation rates under Subsection (c)(1)(B)(ix), the
13	19		commissioner shall exclude:
14	20		(1) students who are ordered by a court to attend a
15	21		high school equivalency certificate program but who have not yet
16	22		earned a high school equivalency certificate;
17	23		(2) students who were previously reported to the state
18	24		as dropouts, including a student who is reported as a dropout,
19	25		reenrolls, and drops out again, regardless of the number of times of
20	26		reenrollment and dropping out;
21	27		(3) students in attendance who are not in membership
22	28		for purposes of average daily attendance;
23	29		(4) students whose initial enrollment in a school in
24	30		the United States in grades 7 through 12 was as an unschooled asylee
25	31		or refugee as defined by Section 39.027(a-1);
26	32		(5) students who are detained at a county
27	33		pre-adjudication or post-adjudication juvenile detention facility
28	34		and:
29	35		(A) in the district exclusively as a function of
30	36		having been detained at the facility but are otherwise not students
31	37		of the district in which the facility is located; or
32	38		(B) provided services by an open-enrollment
33	39		charter school exclusively as the result of having been detained at
34	40		the facility; [and]
35	41		(6) students who are incarcerated in state jails and
36	42		federal penitentiaries as adults and as persons certified to stand
37	43		trial as adults; and
38	44		(7) students who have suffered a condition, injury, or
39	45		illness that requires substantial medical care and leaves the
40	46		student:
41	47		(A) unable to attend school; and
42	48		(B) assigned to a medical or residential
43	49		treatment facility.
44	50		SECTION 2. This Act applies beginning with the 2019-2020
45	51		school year.
46	52		SECTION 3. This Act takes effect immediately if it receives
47	53		a vote of two-thirds of all the members elected to each house, as
48	54		provided by Section 39, Article III, Texas Constitution. If this
49	55		Act does not receive the vote necessary for immediate effect, this
50	56		Act takes effect September 1, 2019.
