| 14 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 15 | 11 | | SECTION 1. Section 43.001(2), Local Government Code, is |
|---|
| 16 | 12 | | amended to read as follows: |
|---|
| 17 | 13 | | (2) "Tier 1 county" means a county: |
|---|
| 18 | 14 | | (A) with a population of less than 500,000; and |
|---|
| 19 | 15 | | (B) that is not: |
|---|
| 20 | 16 | | (i) a county that contains a freshwater |
|---|
| 21 | 17 | | fisheries center operated by the [Texas] Parks and Wildlife |
|---|
| 22 | 18 | | Department; or |
|---|
| 23 | 19 | | (ii) a county with a population of less than |
|---|
| 24 | 20 | | 125,000: |
|---|
| 25 | 21 | | (a) that is adjacent to a county with |
|---|
| 26 | 22 | | a population of more than 2.2 million; |
|---|
| 27 | 23 | | (b) that contains any portion of the |
|---|
| 28 | 24 | | extraterritorial jurisdiction of a municipality with a population |
|---|
| 29 | 25 | | of more than 1.1 million; and |
|---|
| 30 | 26 | | (c) in which more than one municipal |
|---|
| 31 | 27 | | utility district registered with the Texas Commission on |
|---|
| 32 | 28 | | Environmental Quality as being active is located. |
|---|
| 33 | 29 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 34 | 30 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 35 | 31 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 36 | 32 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 37 | 33 | | Act takes effect September 1, 2019. |
