8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Section 122.001, Civil Practice and Remedies | |
10 | 10 | Code, is amended to read as follows: | |
11 | 11 | Sec. 122.001. PROTECTION OF JURORS' EMPLOYMENT; JUROR'S | |
12 | 12 | RIGHT TO REEMPLOYMENT; NOTICE OF INTENT TO RETURN. (a) An [A | |
13 | 13 | private] employer may not discharge, threaten to discharge, | |
14 | 14 | intimidate, or coerce any [terminate the employment of a] permanent | |
15 | 15 | employee because the employee serves as a juror, or for the | |
16 | 16 | employee's attendance or scheduled attendance in connection with | |
17 | 17 | the service, in any court in the United States. | |
18 | 18 | (b) An employee who is discharged, threatened with | |
19 | 19 | discharge, intimidated, or coerced [whose employment is | |
20 | 20 | terminated] in violation of this section is entitled to return to | |
21 | 21 | the same employment that the employee held when summoned for jury | |
22 | 22 | service if the employee, as soon as practical after release from | |
23 | 23 | jury service, gives the employer actual notice that the employee | |
24 | 24 | intends to return. | |
25 | 25 | SECTION 2. This Act takes effect September 1, 2019. |
