410 AN ACT
511 relating to authority of the Lubbock County Hospital District of
612 Lubbock County, Texas, to employ physicians.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Subchapter B, Chapter 1053, Special District
915 Local Laws Code, is amended by adding Section 1053.0601 to read as
1016 follows:
1117 Sec. 1053.0601. EMPLOYMENT OF PHYSICIANS TO PROVIDE CERTAIN
1218 HOSPITAL-BASED SERVICES. (a) For purposes of this section,
1319 "hospital-based services" means the following services when
1420 provided at a hospital:
1521 (1) emergency medicine;
1622 (2) general medicine practiced by a hospitalist; and
1723 (3) radiology services.
1824 (b) The board may employ physicians as the board considers
1925 necessary to provide hospital-based services at a hospital owned or
2026 operated by the district as provided by this section. The board may
2127 retain all or part of the professional income generated by a
2228 physician employed by the district for those hospital-based
2329 services if the board satisfies the requirements of this section.
2430 (c) The term of an employment contract entered into under
2531 this section may not exceed five years.
2632 (d) This section may not be construed as authorizing the
2733 board to:
2834 (1) supervise or control the practice of medicine, as
2935 prohibited by Subtitle B, Title 3, Occupations Code; or
3036 (2) employ physicians for any purpose other than the
3137 provision of hospital-based services at a hospital owned or
3238 operated by the district.
3339 (e) The authority granted to the board under Subsection (b)
3440 to employ physicians shall apply as necessary for the district to
3541 fulfill the district's statutory mandate to provide medical and
3642 hospital care to the district's residents, including the district's
3743 needy and indigent residents, as provided by Sections 1053.101 and
3844 1053.104.
3945 (f) The medical executive committee of the district shall
4046 adopt, maintain, and enforce policies to ensure that a physician
4147 employed by the district exercises the physician's independent
4248 medical judgment in providing care to patients.
4349 (g) The policies adopted by the medical executive committee
4450 under this section must include:
4551 (1) policies relating to:
4652 (A) governance of the medical executive
4753 committee;
4854 (B) credentialing;
4955 (C) quality assurance;
5056 (D) utilization review;
5157 (E) peer review;
5258 (F) medical decision-making; and
5359 (G) due process; and
5460 (2) rules requiring the disclosure of financial
5561 conflicts of interest by a member of the medical executive
5662 committee.
5763 (h) The medical executive committee and the board shall
5864 jointly develop and implement a conflict management process to
5965 resolve any conflict between a policy adopted by the medical
6066 executive committee under this section and a policy of the
6167 district.
6268 (i) A member of the medical executive committee who is a
6369 physician shall provide biennially to the chair of the medical
6470 executive committee a signed, verified statement indicating that
6571 the committee member:
6672 (1) is licensed by the Texas Medical Board;
6773 (2) will exercise independent medical judgment in all
6874 medical executive committee matters, including matters relating
6975 to:
7076 (A) credentialing;
7177 (B) quality assurance;
7278 (C) utilization review;
7379 (D) peer review;
7480 (E) medical decision-making; and
7581 (F) due process;
7682 (3) will exercise the committee member's best efforts
7783 to ensure compliance with the policies that are adopted or
7884 established by the medical executive committee; and
7985 (4) will report immediately to the Texas Medical Board
8086 any action or event that the committee member reasonably and in good
8187 faith believes constitutes a compromise of the independent medical
8288 judgment of a physician in caring for a patient.
8389 (j) For all matters relating to the practice of medicine,
8490 each physician employed by the district shall ultimately report to
8591 the chair of the medical executive committee for the district.
8692 SECTION 2. This Act takes effect immediately if it receives
8793 a vote of two-thirds of all the members elected to each house, as
8894 provided by Section 39, Article III, Texas Constitution. If this
8995 Act does not receive the vote necessary for immediate effect, this
9096 Act takes effect September 1, 2019.
