4	11		AN ACT
5	12		relating to financial assistance paid to the survivors of certain
6	13		law enforcement officers, firefighters, and other public employees
7	14		killed in the line of duty.
8	15		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	16		SECTION 1. Section 615.022, Government Code, is amended to
10	17		read as follows:
11	18		Sec. 615.022. PAYMENT TO SURVIVORS. (a) If there is an
12	19		eligible surviving spouse, the state shall pay the benefits
13	20		described by Subsection (d) [$500,000] to the eligible surviving
14	21		spouse.
15	22		(b) If there is no eligible surviving spouse, the state
16	23		shall pay the benefits described by Subsection (d) [$500,000] in
17	24		equal shares to surviving children.
18	25		(c) If there is no eligible surviving spouse or child, the
19	26		state shall pay the benefits described by Subsection (d) [$500,000]
20	27		in equal shares to surviving parents.
21	28		(d) An eligible survivor, or eligible survivors in equal
22	29		shares, are entitled to receive a lump sum payment in the amount
23	30		provided by this subsection. The lump sum payment amount payable to
24	31		an eligible survivor during the 12 months beginning September 1,
25	32		2019, is $500,000. Effective September 1 of each following year,
26	33		the board of trustees of the Employees Retirement System of Texas by
27	34		rule shall adjust the amount of the lump sum payment required under
28	35		this subsection by an amount equal to the percentage change in the
29	36		Consumer Price Index for All Urban Consumers, published by the
30	37		Bureau of Labor Statistics of the United States Department of Labor
31	38		for the preceding year. The amount paid to an eligible survivor or
32	39		survivors as adjusted under this subsection is calculated based on
33	40		the date of the decedent's death and not on the date the eligible
34	41		survivor or survivors file a claim under this chapter.
35	42		SECTION 2. The changes in law made by this Act apply to a
36	43		payment of assistance to survivors of certain public employees on
37	44		or after the effective date of this Act regardless of the date the
38	45		public employee died.
39	46		SECTION 3. This Act takes effect September 1, 2019.
