| 5 | 11 | | relating to eligibility for the Texas Peace Officers' Memorial |

| 6 | 12 | | Monument. |
|---|
| 7 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 14 | | SECTION 1. Section 3105.003(a), Government Code, is amended |
|---|
| 9 | 15 | | to read as follows: |
|---|
| 10 | 16 | | (a) A person is eligible to have the person's name on the |
|---|
| 11 | 17 | | monument if the person was killed in the line of duty and was: |
|---|
| 12 | 18 | | (1) a law enforcement officer or peace officer for |
|---|
| 13 | 19 | | this state or a political subdivision of this state under Article |
|---|
| 14 | 20 | | 2.12, Code of Criminal Procedure, or other law; |
|---|
| 15 | 21 | | (2) a federal law enforcement officer or special agent |
|---|
| 16 | 22 | | performing duties in this state, including those officers under |
|---|
| 17 | 23 | | Article 2.122, Code of Criminal Procedure; [or] |
|---|
| 18 | 24 | | (3) a corrections or detention officer or county or |
|---|
| 19 | 25 | | municipal jailer employed or appointed by a municipal, county, or |
|---|
| 20 | 26 | | state penal institution in this state; or |
|---|
| 21 | 27 | | (4) employed by this state or a political subdivision |
|---|
| 22 | 28 | | of this state and considered by the person's employer to be a |
|---|
| 23 | 29 | | trainee for a position described by Subdivision (1), (2), or (3). |
|---|
| 24 | 30 | | SECTION 2. (a) Section 3105.003(a), Government Code, as |
|---|
| 25 | 31 | | amended by this Act, applies to the eligibility of a person who was |
|---|
| 26 | 32 | | killed in the line of duty before, on, or after the effective date |
|---|
| 27 | 33 | | of this Act. |
|---|
| 28 | 34 | | (b) The Texas Commission on Law Enforcement shall |
|---|
| 29 | 35 | | reconsider a nomination to have a person's name added to the Texas |
|---|
| 30 | 36 | | Peace Officers' Memorial Monument under Section 3105.0035, |
|---|
| 31 | 37 | | Government Code, if the person was determined to be ineligible |
|---|
| 32 | 38 | | before the effective date of this Act and the person may be eligible |
|---|
| 33 | 39 | | under Section 3105.003(a), Government Code, as amended by this Act. |
|---|
| 34 | 40 | | SECTION 3. This Act takes effect September 1, 2019. |
