9+ A BILL TO BE ENTITLED
410 AN ACT
511 relating to eligibility for the Texas Peace Officers' Memorial
612 Monument.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Section 3105.003(a), Government Code, is amended
915 to read as follows:
1016 (a) A person is eligible to have the person's name on the
1117 monument if the person was killed in the line of duty and was:
1218 (1) a law enforcement officer or peace officer for
1319 this state or a political subdivision of this state under Article
1420 2.12, Code of Criminal Procedure, or other law;
1521 (2) a federal law enforcement officer or special agent
1622 performing duties in this state, including those officers under
1723 Article 2.122, Code of Criminal Procedure; [or]
1824 (3) a corrections or detention officer or county or
1925 municipal jailer employed or appointed by a municipal, county, or
2026 state penal institution in this state; or
2127 (4) employed by this state or a political subdivision
2228 of this state and considered by the person's employer to be a
2329 trainee for a position described by Subdivision (1), (2), or (3).
2430 SECTION 2. (a) Section 3105.003(a), Government Code, as
2531 amended by this Act, applies to the eligibility of a person who was
2632 killed in the line of duty before, on, or after the effective date
2733 of this Act.
2834 (b) The Texas Commission on Law Enforcement shall
2935 reconsider a nomination to have a person's name added to the Texas
3036 Peace Officers' Memorial Monument under Section 3105.0035,
3137 Government Code, if the person was determined to be ineligible
3238 before the effective date of this Act and the person may be eligible
3339 under Section 3105.003(a), Government Code, as amended by this Act.
3440 SECTION 3. This Act takes effect September 1, 2019.
