8	6		AN ACT
9	7		relating to the creation of a work group to advise the Texas
10	8		Workforce Commission regarding the Texas Rising Star Program.
11	9		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	10		SECTION 1. Subchapter G, Chapter 2308, Government Code, is
13	11		amended by adding Section 2308.321 to read as follows:
14	12		Sec. 2308.321. TEXAS RISING STAR PROGRAM REVIEW WORK GROUP.
15	13		(a) The Texas Rising Star Program review work group is established
16	14		to propose revisions to the commission's rules on the Texas Rising
17	15		Star Program.
18	16		(b) The work group consists of the following members
19	17		appointed by the executive director of the commission:
20	18		(1) at least one member from the commission;
21		-	(2) at least one member from the ~~Health and Human~~
22		-	Services ~~Commission~~;
	19	+	(2) at least one member from the Department of Family
	20	+	and Protective Services;
23	21		(3) at least one member from the early childhood
24	22		education division of the Texas Education Agency;
25	23		(4) at least one member from the governor's Texas Early
26	24		Learning Council;
27	25		(5) at least one member who is appointed to a local
28	26		workforce development board;
29	27		(6) at least four members who are Texas Rising Star
30	28		Program providers with different Texas Rising Star Program ratings:
31	29		(A) at least one of whom must be a for-profit
32	30		private provider;
33	31		(B) at least one of whom must be a single-site
34	32		provider;
35	33		(C) at least one of whom must be a multi-site
36	34		provider; and
37	35		(D) at least one of whom must be an individual who
38	36		provides child care in the provider's own home;
39	37		(7) at least one provider who is a Texas School Ready!
40	38		participant;
41	39		(8) at least three members employed by different
42	40		boards who work in the employing board's child-care program and
43	41		have experience and expertise in early childhood development or the
44	42		Texas Rising Star Program or other similar certification or
45	43		accreditation programs; and
46	44		(9) not more than three public members who are
47	45		ineligible for appointment to the work group under Subdivisions
48	46		(1)-(8) and whom the executive director considers indispensable to
49	47		work group purposes.
50	48		(c) The work group shall hold the group's initial meeting
51	49		not later than November 1, 2019, and shall meet at other times as
52	50		determined by the presiding officer.
53	51		(d) The work group shall elect a presiding officer by a vote
54	52		of the membership of the work group.
55	53		(e) Not later than May 1, 2020, the work group shall submit
56	54		to the executive director of the commission recommendations
57	55		proposing revisions to the commission's guidelines relating to the
58	56		Texas Rising Star Program. In making its recommendations, the work
59	57		group shall consider:
60	58		(1) professional development standards for child-care
61	59		directors and employees, including training and annual
62	60		professional development requirements;
63	61		(2) education and experience requirements for mentors
64	62		and evaluators;
65	63		(3) early learning and school readiness standards;
66	64		(4) guidelines for infants and toddlers in child care;
67	65		(5) minimum training hours for providers;
68	66		(6) playground standards, including outdoor learning
69	67		environments;
70	68		(7) nutrition standards;
71	69		(8) standards for use of technology in child care;
72	70		(9) best practices guidelines based on standards
73	71		adopted by nationally recognized organizations, including Head
74	72		Start Program Performance Standards, National Health and Safety
75	73		Performance Standards, National Association for the Education of
76	74		Young Children program standards and accreditation criteria,
77	75		National Association for Family Child Care standards, United States
78	76		Department of Defense standards, national accreditation standards,
79	77		and Texas School Ready! participant standards;
80	78		(10) research on infant and toddler brain development;
81	79		and
82	80		(11) strategies for the long-term financing of the
83	81		Texas Rising Star Program, including:
84	82		(A) financing the payment of:
85	83		(i) incentives to child-care providers
86	84		participating in the program; and
87	85		(ii) grants and rewards to child-care
88	86		providers that achieve and maintain high levels of service; and
89	87		(B) strategies to support wage parity for
90	88		child-care providers participating in the program.
91		-	(f) Not later than September 1, ~~2020~~, the commission shall

94	92		(g) The executive director of the commission shall make the
95	93		appointments under this section on September 1, 2019.
96	94		(h) This section expires December 1, 2020.
97	95		SECTION 2. This Act takes effect September 1, 2019.
