55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the authority of counties and municipalities to lower
88 speed limits on certain highways.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 545.355(b), Transportation Code, is
1111 amended to read as follows:
1212 (b) The commissioners court of a county may declare a lower
1313 speed limit of not less than:
1414 (1) 30 miles per hour on a county road or highway to
1515 which this section applies, if the commissioners court determines
1616 that the prima facie speed limit on the road or highway is
1717 unreasonable or unsafe; or
1818 (2) 10 [20] miles per hour in a residence district,
1919 unless the roadway has been designated as a major thoroughfare by a
2020 municipal [city] planning commission.
2121 SECTION 2. Section 545.356(b-1), Transportation Code, is
2222 amended to read as follows:
2323 (b-1) Except as provided by Subsection (b-3), the governing
2424 body of a municipality, for a highway or a part of a highway in the
2525 municipality that is not an officially designated or marked highway
2626 or road of the state highway system, may declare a lower speed limit
2727 of not less than:
2828 (1) 25 miles per hour for a two-lane, undivided
2929 highway or part of a highway, if the governing body determines that
3030 the prima facie speed limit on the highway is unreasonable or
3131 unsafe; or
3232 (2) 10 miles per hour in a residence district, unless
3333 the roadway has been designated as a major thoroughfare by a
3434 municipal planning commission.
3535 SECTION 3. Section 545.356(b-2), Transportation Code, is
3636 repealed.
3737 SECTION 4. This Act takes effect September 1, 2019.
