86R12748 JXC-D By: Farrar H.B. No. 3901 A BILL TO BE ENTITLED AN ACT relating to the authority of counties and municipalities to lower speed limits on certain highways. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 545.355(b), Transportation Code, is amended to read as follows: (b) The commissioners court of a county may declare a lower speed limit of not less than: (1) 30 miles per hour on a county road or highway to which this section applies, if the commissioners court determines that the prima facie speed limit on the road or highway is unreasonable or unsafe; or (2) 10 [20] miles per hour in a residence district, unless the roadway has been designated as a major thoroughfare by a municipal [city] planning commission. SECTION 2. Section 545.356(b-1), Transportation Code, is amended to read as follows: (b-1) Except as provided by Subsection (b-3), the governing body of a municipality, for a highway or a part of a highway in the municipality that is not an officially designated or marked highway or road of the state highway system, may declare a lower speed limit of not less than: (1) 25 miles per hour for a two-lane, undivided highway or part of a highway, if the governing body determines that the prima facie speed limit on the highway is unreasonable or unsafe; or (2) 10 miles per hour in a residence district, unless the roadway has been designated as a major thoroughfare by a municipal planning commission. SECTION 3. Section 545.356(b-2), Transportation Code, is repealed. SECTION 4. This Act takes effect September 1, 2019.
