4	10		AN ACT
5	11		relating to long-term care insurance for state employees.
6	12		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
7	13		SECTION 1. The heading to Chapter 1552, Insurance Code, is
8	14		amended to read as follows:
9	15		CHAPTER 1552. [GROUP] LONG-TERM CARE INSURANCE FOR STATE EMPLOYEES
10	16		SECTION 2. Section 1552.002, Insurance Code, is amended to
11	17		read as follows:
12	18		Sec. 1552.002. ESTABLISHMENT OF PROGRAM. (a) The board of
13	19		trustees may establish a [group] long-term care insurance program
14	20		to provide long-term care insurance coverage for:
15	21		(1) an individual eligible to participate in the
16	22		program provided by Chapter 1551 as an employee or annuitant;
17	23		(2) the spouse, parent, or grandparent of an employee
18	24		or annuitant; and
19	25		(3) a parent of a spouse described by Subdivision (2).
20	26		(b) The board of trustees may not implement a [group]
21	27		long-term care insurance program unless any cost or administrative
22	28		burden associated with the development of, implementation of, or
23	29		communications about the program is incidental.
24	30		SECTION 3. Section 1552.003, Insurance Code, is amended to
25	31		read as follows:
26	32		Sec. 1552.003. ADMINISTERING FIRM. The board of trustees
27	33		may select an administering firm to administer the [group]
28	34		long-term care insurance program under contract with the board.
29	35		SECTION 4. Section 1552.005(a), Insurance Code, is amended
30	36		to read as follows:
31	37		(a) The [group] long-term care insurance program is not part
32	38		of the group coverages offered under Chapter 1551.
33	39		SECTION 5. Section 1552.006, Insurance Code, is amended to
34	40		read as follows:
35	41		Sec. 1552.006. RULES. The board of trustees may adopt rules
36	42		as necessary to implement this chapter, including rules specifying
37	43		the coverage to be offered under the [group] long-term care
38	44		insurance program.
39	45		SECTION 6. Section 1552.004, Insurance Code, is repealed.
40	46		SECTION 7. The Employees Retirement System of Texas shall
41	47		ensure that all group long-term care insurance coverage in effect
42	48		immediately before the effective date of this Act under Chapter
43	49		1552, Insurance Code, continues to be administered in accordance
44	50		with Chapter 1552, Insurance Code, as it existed immediately before
45	51		the effective date of this Act.
46	52		SECTION 8. This Act takes effect September 1, 2019.
