65 AN ACT
76 relating to authorization by the Texas Higher Education
87 Coordinating Board for certain public junior colleges to offer
98 baccalaureate degree programs.
109 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1110 SECTION 1. Section 130.306, Education Code, is amended by
12- amending Subsection (b) and adding Subsections (d) and (e) to read
13- as follows:
14- (b) Except as otherwise provided by this section
15- [Subsection (a)], a public junior college offering a baccalaureate
16- degree program under this subchapter may not offer more than three
17- baccalaureate degree programs at any time.

13+ (b) Except as provided by Subsections (a) and (d), a public
14+ junior college offering a baccalaureate degree program under this
15+ subchapter may not offer more than three baccalaureate degree

1817 (d) A public junior college offering a baccalaureate degree
1918 program under this subchapter that is located in a county with a
20- population of more than 1,700,000 based on United States Census
19+ population of more than 1,800,000 based on United States Census
2120 2010 data and that is located within 180 miles of the Texas-Mexico
22- border may not offer more than five baccalaureate degree programs
23- at any time.
24- (e) At any time, South Texas College may not offer more than
25- six baccalaureate degree programs under this subchapter.

2623 SECTION 2. This Act takes effect immediately if it receives
2724 a vote of two-thirds of all the members elected to each house, as
2825 provided by Section 39, Article III, Texas Constitution. If this
2926 Act does not receive the vote necessary for immediate effect, this
3027 Act takes effect September 1, 2019.
