96 relating to the maintenance and operation of certain projects by
107 certain drainage districts.
118 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
129 SECTION 1. Chapter 34, Acts of the 57th Legislature, 3rd
1310 Called Session, 1962, is amended by adding Section 19 to read as
1411 follows:
1512 Sec. 19. (a) The District may enter into a project
1613 partnership agreement with the United States Army Corps of
1714 Engineers for a project proposed to be located in the District and
1815 listed in the Sabine Pass to Galveston Bay Texas Coastal Storm Risk
1916 Management and Ecosystem Restoration report published by the United
2017 States Army Corps of Engineers in May 2017. If the District enters
2118 into a project partnership agreement under this subsection, the
2219 District:
2320 (1) must:
2421 (A) develop a maintenance and operation plan for
2522 the proposed project; and
2623 (B) biennially submit a report to the General
2724 Land Office and the legislature on expenditures of state money
2825 relating to a project described by this subsection; and
29- (2) may enter into an agreement:
30- (A) for a public-private partnership to fund a
31- local share of or the costs of the operation and maintenance of a
32- project described by this subsection; or
33- (B) with the General Land Office to obtain
34- funding for a local match requirement or the operation and
35- maintenance of a project described by this subsection.
26+ (2) may enter into an agreement for a public-private
27+ partnership to fund a local share of or the costs of the operation
28+ and maintenance of a project described by this subsection.
3629 (a-1) If the District enters into a project partnership
3730 agreement under this section before November 1, 2020, the initial
38- report described by Subsection (a)(1)(B) of this section must be
39- submitted not later than December 1, 2020. This subsection expires
40- January 1, 2021.
41- (b) If a project described by Subsection (a) of this section
42- is built in the District, the District may accept money from any
43- source to:
31+ report described by Subsection (a)(1)(B) must be submitted not
32+ later than December 1, 2020. This subsection expires January 1,
33+ 2021.
34+ (b) If a project described by Subsection (a) is built in the
35+ District, the District may accept money from any source to:
4436 (1) fund the maintenance and operation of the project;
4537 and
4638 (2) provide local matching funds required by the
4739 project partnership agreement with the United States Army Corps of
4840 Engineers.
4941 SECTION 2. Chapter 307, Acts of the 58th Legislature,
5042 Regular Session, 1963, is amended by adding Section 20 to read as
5143 follows:
5244 Sec. 20. (a) The District may enter into a project
5345 partnership agreement with the United States Army Corps of
5446 Engineers for a project proposed to be located in the District and
5547 listed in the Sabine Pass to Galveston Bay Texas Coastal Storm Risk
5648 Management and Ecosystem Restoration report published by the United
5749 States Army Corps of Engineers in May 2017. If the District enters
5850 into a project partnership agreement under this subsection, the
5951 District:
6052 (1) must:
6153 (A) develop a maintenance and operation plan for
6254 the proposed project; and
6355 (B) biennially submit a report to the General
6456 Land Office and the legislature on expenditures of state money
6557 relating to a project described by this subsection; and
66- (2) may enter into an agreement:
67- (A) for a public-private partnership to fund a
68- local share of or the costs of the operation and maintenance of a
69- project described by this subsection; or
70- (B) with the General Land Office to obtain
71- funding for a local match requirement or the operation and
72- maintenance of a project described by this subsection.
58+ (2) may enter into an agreement for a public-private
59+ partnership to fund a local share of or the costs of the operation
60+ and maintenance of a project described by this subsection.
7361 (a-1) If the District enters into a project partnership
7462 agreement under this section before November 1, 2020, the initial
75- report described by Subsection (a)(1)(B) of this section must be
76- submitted not later than December 1, 2020. This subsection expires
77- January 1, 2021.
78- (b) If a project described by Subsection (a) of this section
79- is built in the District, the District may accept money from any
80- source to:

8673 SECTION 3. Chapter 44, Acts of the 57th Legislature, 3rd
8774 Called Session, 1962, is amended by adding Section 14 to read as

89- Sec. 14. (a) The District may enter into a project

10290 relating to a project described by this subsection; and
103- (2) may enter into an agreement:
104- (A) for a public-private partnership to fund a
105- local share of or the costs of the operation and maintenance of a
106- project described by this subsection; or
107- (B) with the General Land Office to obtain
108- funding for a local match requirement or the operation and
109- maintenance of a project described by this subsection.
91+ (2) may enter into an agreement for a public-private
92+ partnership to fund a local share of or the costs of the operation
93+ and maintenance of a project described by this subsection.
11094 (a-1) If the District enters into a project partnership
11195 agreement under this section before November 1, 2020, the initial
112- report described by Subsection (a)(1)(B) of this section must be

115- (b) If a project described by Subsection (a) of this section
116- is built in the District, the District may accept money from any

123106 SECTION 4. This Act takes effect September 1, 2019.
