| 5 | 11 | | relating to the sale of alcoholic beverages in areas annexed or |
|---|
| 6 | 12 | | owned by certain municipalities. |
|---|
| 7 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 14 | | SECTION 1. Section 251.726(a), Alcoholic Beverage Code, is |
|---|
| 9 | 15 | | amended to read as follows: |
|---|
| 10 | 16 | | (a) This section applies only to a municipality that has |
|---|
| 11 | 17 | | within its boundaries all or part of an international airport |
|---|
| 12 | 18 | | operated jointly by two municipalities and: |
|---|
| 13 | 19 | | (1) that is: |
|---|
| 14 | 20 | | (A) partially located in three counties, two of |
|---|
| 15 | 21 | | which have a population of 1.8 million or more; and |
|---|
| 16 | 22 | | (B) [(2) is] primarily located in a county with |
|---|
| 17 | 23 | | a population of 1.8 million or more; or |
|---|
| 18 | 24 | | (2) that: |
|---|
| 19 | 25 | | (A) is partially located in five counties, one of |
|---|
| 20 | 26 | | which: |
|---|
| 21 | 27 | | (i) has a population of 1.8 million or more; |
|---|
| 22 | 28 | | and |
|---|
| 23 | 29 | | (ii) is adjacent to a county with a |
|---|
| 24 | 30 | | population of 2.2 million or more; |
|---|
| 25 | 31 | | (B) is subject to a limited purpose annexation |
|---|
| 26 | 32 | | and development agreement under Subchapter G, Chapter 212, Local |
|---|
| 27 | 33 | | Government Code; and |
|---|
| 28 | 34 | | (C) may annex an area on request of the owners of |
|---|
| 29 | 35 | | land in the area under Subchapter C-3, Chapter 43, Local Government |
|---|
| 30 | 36 | | Code [(3) has within its boundaries all or part of an |
|---|
| 31 | 37 | | international airport operated jointly by two municipalities]. |
|---|
| 32 | 38 | | SECTION 2. The change in law made by this Act applies to an |
|---|
| 33 | 39 | | area annexed or acquired by a municipality before, on, or after the |
|---|
| 34 | 40 | | effective date of this Act. |

| 35 | 41 | | SECTION 3. This Act takes effect September 1, 2019. |
