68 AN ACT
79 relating to a task force to study access to legal services for
810 persons with disabilities.
911 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1012 SECTION 1. TASK FORCE. (a) In this section:
1113 (1) "Disability" means, with respect to an individual,
1214 a mental or physical impairment that substantially limits at least
1315 one major life activity of that individual.
1416 (2) "Task force" means the task force established by
1517 this section.
1618 (b) The executive commissioner of the Health and Human
1719 Services Commission shall establish a task force to study access to
1820 legal services for persons with disabilities.
1921 (c) The task force shall be composed of seven members as
2022 follows:
2123 (1) five members appointed by the executive
2224 commissioner of the Health and Human Services Commission,
2325 including:
2426 (A) at least two members who are adults with
2527 disabilities; and
2628 (B) at least two members who are parents of
2729 children with disabilities; and
2830 (2) two members who represent Disability Rights Texas.
2931 (d) The executive commissioner of the Health and Human
3032 Services Commission shall designate a member as the presiding
3133 officer of the task force.
3234 (e) The task force shall meet at least quarterly at the call
3335 of the presiding officer and at other times determined by the
3436 presiding officer.
3537 (f) The task force shall study access to legal services for
3638 persons with disabilities. The study must examine and make
3739 recommendations regarding:
3840 (1) the availability of legal representation for
3941 persons with disabilities;
4042 (2) the availability of advocacy and legal services
4143 for persons with disabilities; and
4244 (3) the barriers to accessing legal services for
4345 persons with disabilities, including communication, financial,
4446 medical, and cognitive barriers.
4547 (g) The task force shall develop and submit a written report
4648 of the study and recommendations developed by the task force to the
4749 Health and Human Services Commission, the governor, the lieutenant
4850 governor, the speaker of the house of representatives, and each
4951 member of the legislature not later than December 1, 2020.
5052 (h) The task force may develop instructional and training
5153 materials for legal professionals and persons with disabilities
5254 relating to legal issues affecting persons with disabilities.
5355 (i) The task force may partner with or seek and accept
5456 assistance from voluntary organizations active in supporting
5557 persons with disabilities.
5658 (j) The task force is abolished and this Act expires June 1,
5759 2021.
5860 SECTION 2. EFFECTIVE DATE. This Act takes effect
5961 immediately if it receives a vote of two-thirds of all the members
6062 elected to each house, as provided by Section 39, Article III, Texas
6163 Constitution. If this Act does not receive the vote necessary for
6264 immediate effect, this Act takes effect September 1, 2019.
