| 6 | 14 | | higher education include a notation on a student's transcript under |
|---|
| 7 | 15 | | certain circumstances. |

| 8 | 16 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 17 | | SECTION 1. Subchapter Z, Chapter 51, Education Code, is |
|---|
| 10 | 18 | | amended by adding Section 51.9364 to read as follows: |
|---|
| 11 | 19 | | Sec. 51.9364. CERTAIN NOTATIONS REQUIRED ON STUDENT |
|---|
| 12 | 20 | | TRANSCRIPTS. (a) In this section, "postsecondary educational |
|---|
| 13 | 21 | | institution" means an institution of higher education or a private |
|---|
| 14 | 22 | | or independent institution of higher education, as those terms are |
|---|
| 15 | 23 | | defined by Section 61.003. |
|---|
| 16 | 24 | | (b) If a student is ineligible to reenroll in a |
|---|
| 17 | 25 | | postsecondary educational institution for a reason other than an |
|---|
| 18 | 26 | | academic or financial reason, the institution shall include on the |
|---|
| 19 | 27 | | student's transcript a notation stating that the student is |
|---|
| 20 | 28 | | ineligible to reenroll in the institution for a reason other than an |
|---|
| 21 | 29 | | academic or financial reason. |
|---|
| 22 | 30 | | (c) If a student withdraws from a postsecondary educational |
|---|
| 23 | 31 | | institution pending disciplinary charges that may result in the |
|---|
| 24 | 32 | | student becoming ineligible to reenroll in the institution for a |
|---|
| 25 | 33 | | reason other than an academic or financial reason, the institution |
|---|
| 26 | 34 | | may not end the disciplinary process until the institution makes a |
|---|
| 27 | 35 | | final determination of responsibility, including, if applicable, a |
|---|
| 28 | 36 | | determination of whether the student will be ineligible to reenroll |
|---|
| 29 | 37 | | in the institution for a reason other than an academic or financial |
|---|
| 30 | 38 | | reason. If, as a result of the disciplinary process, the student is |
|---|
| 31 | 39 | | ineligible to reenroll in the institution for a reason other than an |
|---|
| 32 | 40 | | academic or financial reason, the institution shall include on the |
|---|
| 33 | 41 | | student's transcript the notation required under Subsection (b). |
|---|
| 34 | 42 | | (d) On request by the student, a postsecondary educational |
|---|
| 35 | 43 | | institution may remove from a student's transcript a notation |
|---|
| 36 | 44 | | required under this section if: |
|---|
| 37 | 45 | | (1) the student is eligible to reenroll in the |
|---|
| 38 | 46 | | institution; or |
|---|
| 39 | 47 | | (2) the institution determines that good cause exists |
|---|
| 40 | 48 | | to remove the notation. |
|---|
| 41 | 49 | | (e) The Texas Higher Education Coordinating Board shall |
|---|
| 42 | 50 | | adopt rules as necessary to implement this section. In adopting |
|---|
| 43 | 51 | | those rules, the coordinating board shall use the negotiated |
|---|
| 44 | 52 | | rulemaking procedures under Chapter 2008, Government Code. |
|---|
| 45 | 53 | | SECTION 2. The Texas Higher Education Coordinating Board |
|---|
| 46 | 54 | | shall adopt the rules required by Section 51.9364, Education Code, |
|---|
| 47 | 55 | | as added by this Act, as soon as practicable after this Act takes |
|---|
| 48 | 56 | | effect. |
|---|
| 49 | 57 | | SECTION 3. The change in law made by this Act applies |
|---|
| 50 | 58 | | beginning with the 2019 fall semester. |
|---|
| 51 | 59 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 52 | 60 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 53 | 61 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 54 | 62 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 55 | 63 | | Act takes effect September 1, 2019. |
