412 AN ACT
513 relating to a requirement that a public or private institution of
614 higher education include a notation on a student's transcript under
715 certain circumstances.
816 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
917 SECTION 1. Subchapter Z, Chapter 51, Education Code, is
1018 amended by adding Section 51.9364 to read as follows:
1119 Sec. 51.9364. CERTAIN NOTATIONS REQUIRED ON STUDENT
1220 TRANSCRIPTS. (a) In this section, "postsecondary educational
1321 institution" means an institution of higher education or a private
1422 or independent institution of higher education, as those terms are
1523 defined by Section 61.003.
1624 (b) If a student is ineligible to reenroll in a
1725 postsecondary educational institution for a reason other than an
1826 academic or financial reason, the institution shall include on the
1927 student's transcript a notation stating that the student is
2028 ineligible to reenroll in the institution for a reason other than an
2129 academic or financial reason.
2230 (c) If a student withdraws from a postsecondary educational
2331 institution pending disciplinary charges that may result in the
2432 student becoming ineligible to reenroll in the institution for a
2533 reason other than an academic or financial reason, the institution
2634 may not end the disciplinary process until the institution makes a
2735 final determination of responsibility, including, if applicable, a
2836 determination of whether the student will be ineligible to reenroll
2937 in the institution for a reason other than an academic or financial
3038 reason. If, as a result of the disciplinary process, the student is
3139 ineligible to reenroll in the institution for a reason other than an
3240 academic or financial reason, the institution shall include on the
3341 student's transcript the notation required under Subsection (b).
3442 (d) On request by the student, a postsecondary educational
3543 institution may remove from a student's transcript a notation
3644 required under this section if:
3745 (1) the student is eligible to reenroll in the
3846 institution; or
3947 (2) the institution determines that good cause exists
4048 to remove the notation.
4149 (e) The Texas Higher Education Coordinating Board shall
4250 adopt rules as necessary to implement this section. In adopting
4351 those rules, the coordinating board shall use the negotiated
4452 rulemaking procedures under Chapter 2008, Government Code.
4553 SECTION 2. The Texas Higher Education Coordinating Board
4654 shall adopt the rules required by Section 51.9364, Education Code,
4755 as added by this Act, as soon as practicable after this Act takes
4856 effect.
4957 SECTION 3. The change in law made by this Act applies
5058 beginning with the 2019 fall semester.
5159 SECTION 4. This Act takes effect immediately if it receives
5260 a vote of two-thirds of all the members elected to each house, as
5361 provided by Section 39, Article III, Texas Constitution. If this
5462 Act does not receive the vote necessary for immediate effect, this
5563 Act takes effect September 1, 2019.
