| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 33.9031, Education Code, is amended by |
|---|
| 12 | 12 | | amending Subsection (c) and adding Subsection (e) to read as |
|---|
| 13 | 13 | | follows: |
|---|
| 14 | 14 | | (c) A school district shall conduct a request for proposals |
|---|
| 15 | 15 | | procurement process to enable the district to determine if |
|---|
| 16 | 16 | | contracting with a licensed child-care facility or a facility or |
|---|
| 17 | 17 | | program that is exempt from the child-care licensing requirements |
|---|
| 18 | 18 | | under Section 42.041, Human Resources Code, that provides a |
|---|
| 19 | 19 | | before-school or after-school program, as defined by Section |
|---|
| 20 | 20 | | 42.002, Human Resources Code, to provide the district's |
|---|
| 21 | 21 | | before-school or after-school program would serve the district's |
|---|
| 22 | 22 | | best interests. Following the request for proposals procurement |
|---|
| 23 | 23 | | process, the district may enter into a contract with a child-care |
|---|
| 24 | 24 | | facility or implement a before-school or after-school program |
|---|
| 25 | 25 | | operated by the district. If the district enters into a contract |
|---|
| 26 | 26 | | with a child-care facility, the contract must comply with the |
|---|
| 27 | 27 | | requirements of Section 44.031 and may not exceed a term of three |
|---|
| 28 | 28 | | years. |
|---|
| 29 | 29 | | (e) A school district may not use Foundation School Program |
|---|
| 30 | 30 | | funds to establish or operate a before-school or after-school |
|---|
| 31 | 31 | | program under this section. |
|---|
| 32 | 32 | | SECTION 2. This Act takes effect September 1, 2019. |
