55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the applicability of certain requirements and
88 restrictions on funding for before-school and after-school
99 programs established by school districts.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 33.9031, Education Code, is amended by
1212 amending Subsection (c) and adding Subsection (e) to read as
1313 follows:
1414 (c) A school district shall conduct a request for proposals
1515 procurement process to enable the district to determine if
1616 contracting with a licensed child-care facility or a facility or
1717 program that is exempt from the child-care licensing requirements
1818 under Section 42.041, Human Resources Code, that provides a
1919 before-school or after-school program, as defined by Section
2020 42.002, Human Resources Code, to provide the district's
2121 before-school or after-school program would serve the district's
2222 best interests. Following the request for proposals procurement
2323 process, the district may enter into a contract with a child-care
2424 facility or implement a before-school or after-school program
2525 operated by the district. If the district enters into a contract
2626 with a child-care facility, the contract must comply with the
2727 requirements of Section 44.031 and may not exceed a term of three
2828 years.
2929 (e) A school district may not use Foundation School Program
3030 funds to establish or operate a before-school or after-school
3131 program under this section.
3232 SECTION 2. This Act takes effect September 1, 2019.
