 programs established by school districts.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 33.9031, Education Code, is amended by
amending Subsection (c) and adding Subsection (e) to read as
 follows:
 (c) A school district shall conduct a request for proposals
procurement process to enable the district to determine if
contracting with a licensed child-care facility or a facility or
program that is exempt from the child-care licensing requirements
under Section 42.041, Human Resources Code, that provides a
before-school or after-school program, as defined by Section

requirements of Section 44.031 and may not exceed a term of three
 years.
 (e) A school district may not use Foundation School Program
funds to establish or operate a before-school or after-school
 program under this section.
SECTION 2. This Act takes effect September 1, 2019.
