| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 6002.004(d), Insurance Code, is amended |
|---|
| 10 | 10 | | to read as follows: |
|---|
| 11 | 11 | | (d) Subsection (b) does not apply to: |
|---|
| 12 | 12 | | (1) a political subdivision: |
|---|
| 13 | 13 | | (A) [(1)] in a county with a population of less |
|---|
| 14 | 14 | | than 80,000; or |
|---|
| 15 | 15 | | (B) [(2)] in which monitoring is not otherwise |
|---|
| 16 | 16 | | provided or available; or |
|---|
| 17 | 17 | | (2) a municipality: |
|---|
| 18 | 18 | | (A) with a population of less than 5,000; and |
|---|
| 19 | 19 | | (B) adjacent to: |
|---|
| 20 | 20 | | (i) a municipality with a population of |
|---|
| 21 | 21 | | more than two million; and |
|---|
| 22 | 22 | | (ii) at least one municipality with a |
|---|
| 23 | 23 | | population of less than 5,000. |

| 24 | 24 | | SECTION 2. Section 1702.3705(c), Occupations Code, is |
|---|
| 25 | 25 | | amended to read as follows: |
|---|
| 26 | 26 | | (c) The limitations of Subsection (a) do not apply to: |
|---|
| 27 | 27 | | (1) a political subdivision: |
|---|
| 28 | 28 | | (A) in a county with a population of less than |
|---|
| 29 | 29 | | 80,000; or |
|---|
| 30 | 30 | | (B) in which [or in a political subdivision |
|---|
| 31 | 31 | | where] monitoring is not otherwise provided or available; or |
|---|
| 32 | 32 | | (2) a municipality: |
|---|
| 33 | 33 | | (A) with a population of less than 5,000; and |
|---|
| 34 | 34 | | (B) adjacent to: |
|---|
| 35 | 35 | | (i) a municipality with a population of |
|---|
| 36 | 36 | | more than two million; and |
|---|
| 37 | 37 | | (ii) at least one municipality with a |
|---|
| 38 | 38 | | population of less than 5,000. |

| 39 | 39 | | SECTION 3. This Act takes effect September 1, 2019. |
