44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the provision of alarm system services by certain
77 municipalities.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 6002.004(d), Insurance Code, is amended
1010 to read as follows:
1111 (d) Subsection (b) does not apply to:
1212 (1) a political subdivision:
1313 (A) [(1)] in a county with a population of less
1414 than 80,000; or
1515 (B) [(2)] in which monitoring is not otherwise
1616 provided or available; or
1717 (2) a municipality:
1818 (A) with a population of less than 5,000; and
1919 (B) adjacent to:
2020 (i) a municipality with a population of
2121 more than two million; and
2222 (ii) at least one municipality with a
2323 population of less than 5,000.
2424 SECTION 2. Section 1702.3705(c), Occupations Code, is
2525 amended to read as follows:
2626 (c) The limitations of Subsection (a) do not apply to:
2727 (1) a political subdivision:
2828 (A) in a county with a population of less than
2929 80,000; or
3030 (B) in which [or in a political subdivision
3131 where] monitoring is not otherwise provided or available; or
3232 (2) a municipality:
3333 (A) with a population of less than 5,000; and
3434 (B) adjacent to:
3535 (i) a municipality with a population of
3636 more than two million; and
3737 (ii) at least one municipality with a
3838 population of less than 5,000.
3939 SECTION 3. This Act takes effect September 1, 2019.
