411 AN ACT
512 relating to the issuance of posthumous high school diplomas to
613 certain students.
714 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
815 SECTION 1. Section 28.0254(a), Education Code, is amended
916 to read as follows:
1017 (a) Notwithstanding any other provision of this code, but
1118 subject to Subsection (b), on request of the student's parent, a
1219 school district shall issue a high school diploma posthumously to
1320 each student who died while enrolled in the district [at grade level
1421 12, provided that the student was academically on track at the time
1522 of death to receive a diploma] at the end of the school year in which
1623 the student was expected to graduate under the regular schedule of
1724 school attendance [in which the student died]. The high school
1825 diploma may not be issued before the graduation date of the class in
1926 which the student was enrolled at the time of death [For purposes
2027 of this subsection, "school year" includes any summer session
2128 following the spring semester].
2229 SECTION 2. Section 28.0254(a), Education Code, as amended
2330 by this Act, applies beginning with students who would have
2431 graduated at the end of the 2019-2020 school year.
2532 SECTION 3. This Act takes effect immediately if it receives
2633 a vote of two-thirds of all the members elected to each house, as
2734 provided by Section 39, Article III, Texas Constitution. If this
2835 Act does not receive the vote necessary for immediate effect, this
2936 Act takes effect September 1, 2019.
