4	11		AN ACT
5	12		relating to the issuance of posthumous high school diplomas to
6	13		certain students.
7	14		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	15		SECTION 1. Section 28.0254(a), Education Code, is amended
9	16		to read as follows:
10	17		(a) Notwithstanding any other provision of this code, but
11	18		subject to Subsection (b), on request of the student's parent, a
12	19		school district shall issue a high school diploma posthumously to
13	20		each student who died while enrolled in the district [at grade level
14	21		12, provided that the student was academically on track at the time
15	22		of death to receive a diploma] at the end of the school year in which
16	23		the student was expected to graduate under the regular schedule of
17	24		school attendance [in which the student died]. The high school
18	25		diploma may not be issued before the graduation date of the class in
19	26		which the student was enrolled at the time of death [For purposes
20	27		of this subsection, "school year" includes any summer session
21	28		following the spring semester].
22	29		SECTION 2. Section 28.0254(a), Education Code, as amended
23	30		by this Act, applies beginning with students who would have
24	31		graduated at the end of the 2019-2020 school year.
25	32		SECTION 3. This Act takes effect immediately if it receives
26	33		a vote of two-thirds of all the members elected to each house, as
27	34		provided by Section 39, Article III, Texas Constitution. If this
28	35		Act does not receive the vote necessary for immediate effect, this
29	36		Act takes effect September 1, 2019.
