66 AN ACT
77 relating to an affirmative defense to the offense of operating a
88 vehicle without displaying two license plates.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 504.943, Transportation Code, is amended
1111 by adding Subsection (d-1) to read as follows:
1212 (d-1) It is an affirmative defense to prosecution under
1313 Subsection (a) for failure to display a license plate at the front
1414 of a vehicle that the vehicle:
1515 (1) is equipped with driving sensors the functioning
1616 of which would be impaired by the display of a front license plate;
1717 or
1818 (2) was not equipped by the manufacturer with a
1919 mounting plate for a front license plate.
2020 SECTION 2. The change in law made by this Act applies only
2121 to an offense committed on or after the effective date of this Act.
2222 An offense committed before the effective date of this Act is
2323 covered by the law in effect on the date the offense was committed,
2424 and the former law is continued in effect for that purpose. For
2525 purposes of this section, an offense was committed before the
2626 effective date of this Act if any element of the offense occurred
2727 before that date.
2828 SECTION 3. This Act takes effect September 1, 2019.
