 A BILL TO BE ENTITLED
 AN ACT
 relating to an affirmative defense to the offense of operating a
 vehicle without displaying two license plates.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Section 504.943, Transportation Code, is amended
 by adding Subsection (d-1) to read as follows:
 (d-1)  It is an affirmative defense to prosecution under
 Subsection (a) for failure to display a license plate at the front
 of a vehicle that the vehicle:
 (1)  is equipped with driving sensors the functioning
 of which would be impaired by the display of a front license plate;
 or
 (2)  was not equipped by the manufacturer with a
 mounting plate for a front license plate.
 SECTION 2.  The change in law made by this Act applies only
 to an offense committed on or after the effective date of this Act.
 An offense committed before the effective date of this Act is
 covered by the law in effect on the date the offense was committed,
 and the former law is continued in effect for that purpose. For
 purposes of this section, an offense was committed before the
 effective date of this Act if any element of the offense occurred
 before that date.
 SECTION 3.  This Act takes effect September 1, 2019.
